Our Cooperative Housing Society herein referred as "Society"has signed with a Developer in Maharashtra for redevelopment of the Society.
The developer has requested that we need to sign a JV with them as they opine that the Society is a 'Promoter' as per the new definition of 'Promoter'in the new
Maha RERA.
Pl advice whether his contention is correct, else guide the relevant section or Notification No to challenge his claim, thereby avoiding unnecessary hassles.

My father died in 2013. We are 4 sons and 1 sister and our mother is alive. My father left behind an agricultural land plus a big site having a small house, all of which is his self earned property.
1. What is the procedure to transfer this to our name?
2. What is the procedure to divide this property among ourselves?

Respected Sir / Madam,
Could you please let me know whether sanctioned plan approval number for an apartment under municipal limits in chennai needs to be definitely mentioned in the construction agreement or is it optional? Currently, construction agreement draft version states that the builder would get approval from the competent authority/ies but it doesn't specify the approval reference number. Would it be fine to exclude the number? Request all to throw light on this. Thank you.

Hi,
My family has been living in our current house for more than 40 years.
The land belongs to our landlady but the house was built and maintained by us.
My grandfather was a the original rentee and he passed away 35 years ago.
Post his death, our landlady passed away as well and since then her sister's son has been collecting rent and issuing receipts for the same in my grandmother and mother's name (2 rooms).
However, we recently learnt that the property is still registered to the landlady and her sister's son does not have any documents proving that he is the legal heir. Nor has he paid any property tax for years now.
On confronting him, he said that he had a POA in his name given by the landlady. He now wants to give our neighbours the POA and move out of this. Our neighbours and we already have a case pending in the court since they (neighbours) are trying to forcefully take possession of the attic of our side of the house which has been in our possession for the past 30 years.
My question here is, is he legally allowed to take rent from us when the property does not belong to him?
Also, can he transfer ownership of the land to our neighbours? Doesn't the POA gets nullified with death of the person giving the POA?
Should we approach the rent controller and deposit the rent with the court?

One Shop Room of about 100 Sq.ft. of my building at the main road of B.K.Paul Avenue,Kolkata-5 is let out to one person for more than 20 years ago @Rs.70/- p.m.He refused to increase Rent.I did not accept rent & he started to deposit the same in Rent Controller. What is the Fair Rent as per rules which I can ask from him? Where & What is the legal action I can take against him if he refuses to increase the Rent & how much time it will take to get the decision in my favor.
Purchase of property in a family
Hello,
My grandmother had 6 katha of land which was divided into four parts in 2002. it was divided among my father,my uncle( younger brother of my father), my paternal aunt(elder sister of my father) and paternal sister( daughter of my fathers elder brother). my paternal uncle(my fathers elder brother) passed away in 2010 and no one lives in that property since that time as his daughter is a married woman and lives in different place. now she is willing to sell the property and proposal come to me as I am the only male child
in my family. I have applied for a home loan, but the concern bank is denied to give a loan by showing the reason of blood relation and stated I cant purchase the property as we are in same blood relation.
Now my question is my paternal sister ( daughter of my fathers elder brother) who got married to different family, different cast, lives in different place in same blood relation of mine? is there any property law which defines the blood relation in a family from whom we can purchase the property? is it possible to purchase that property from my paternal sister ( daughter of my fathers elder brother)?
Thanks in advance
