WE have a Land in a small village in andhra Pradesh. It is 1 acre. It is in the Name of our mother. Due to My mother health condition, WE shifted to City for better Treatment 5 years back. We left the land vacant. Every year we Go to our village once and Check our Land. Recently WE visited our village and got shocked by seeing our neighbour farmer is doing agriculture in our Land.
We asked him that it is our Land. Why are you occupying our Land. Then He replied "who said it is your Land? I am doing agriculture in this Land since 20 years".
Then we asked our other neighbour farmers for Justice. They are not supporting US. They are Also talking in His side.
Then we replied " WE have All records and Land tax receipt and we will Go to Court for Justice". Then He said " this is village. I have all neighbour Farmers Support. They are belonging to My caste. You may have records but you dont have possession and neighbour Farmers Support. You will Not win the case in Court. Court will give justice in My favour".
Please help us in this issue.

hi, i am nitin from haryana. my religion is hindu. sir i have lost the property suit in civil court. but we found some mistakes in written judgement. now my questions is:- 1. what is the procedure of correction in judgement. 2. how much time it will take. 3. what happen if court found that this mistake is not clerical or typographycal mistake. 4. is it possible that it will change the decision of court. please suggest me its very important for me

i am from telangana.my grandfather died in 1996 without no will.he has 4 sons and 1 daughter,i am the son of the daughter.my uncles divided my grandfather's property into four equal shares and they are the owners of the land now.my mother got frustrated by asking her share to them and finally filed a case against them.she got married in 1983.but the lawyer said there is ambiguity in the case as she was married before the hindu sucession act in andhra pradesh came into force which came into force on sep 1985.cannot she claim her property by hindu sucession act 1956.does she has any right on the property now and can win the case in the court and get her share.

There was a property in the name of my father in law's mother. She expired when my son is in womb(6 months). After her death , my father in law , his brothers and a sister shared that property using 1956 Hindu succession act when my son was 9 months in womb. They told my husband & her sister don't have rights as it is their mother's property. Now my son is 6 years old. Is there any rights for my son in the property as he becomes 4th generation of the property. My husband is expired now leaving a little son. My in laws never allow me to reside in that house. Kindly advise me .

My sister is a senior citizen, she owns an ownership flat at Kandivali, Mumbai jointly with her husband. Her name stands first in the share certificate and the registered documents and the name of her husband stands second at both places. She does not have any children. Her husband demised some time back.
What is her position with regards to the ownership of the flat? does she automatically become the sole owner or she has to get a succession certificate from the Court? can she sell the flat?
What should she write to the society to delete the name of her husband from the share certificate? How can the name of her husband be deleted from the registered documents of the flat?
Your advice and guidance is requested.

hello ,
My father recently gave me a deed of transferring a Factory(metal processing plant) and all its property plus liabilities as a deed of Gift.
According to the deed...he retains the General power of Attorney and also a Special Power of Attorney along with rights to invest the profits of the business..
This makes me think is signing this deed any good for me as it gives me all the responsibilities(which i am happy to undertake) along with me being Liable for any losses.
so my query is a 2 part query.
1.Is it okay for me to sign the deed and just be a nominal head when my father invests profits and makes big decisions?
2. in case i sign this will my elder brother be able to have any rights to the property in the future considering it is a gift made to me by my father?

We plan to sell a property at Uttar Pradesh soon at rs 90 Lakhs. Please let us know if we are supposed to pay any tax and if yes then the approximate tax that is payable.
