Right's of grandfather's property to grandson!

Hi

A little big case, seeking advice from the experts! My Grandfather's property is in Dharmapuri, Tamil Nadu, after his death, the property was transferred to my grandmother! They have one elder son, who is my father and five sisters, the husband of last sister convinced my innocent and illiterate grandmother to transfer the share from the property to his wife without the knowledge of my father who holds responsible for the property!

After this incident, my father transferred the property to his name as family settlement and later settled the shares to all his sisters! Being a retired central government employee as deputy director he haven't earned a single piece of asset and never spent money for family, spent a lot for his pet son and spent some for his pet daughter and the last one, me, never cared and there the relationship between father n son started to break! Being a typist in state government my mother supported and i have completed MBA!

To marry a girl whom I love from my school days, caste problem raised and my father dint helped me in any situation! To sort out the caste issue, and without disturbing my mother and to achieve big, started searching and found 100% scholarship for pilot training and won it in merit, 1 out of top 10 all over India!

During the initial stage of the toughest course, my girl's parents tortured her, harassed her mentally oly due to the caste issue, and they dont know about the pilot course or career! All these problems mentally disturbed and vmade me to quit the course for time being and marry her! We lead a peaceful life and planned to start an export unit, with proper qualification and experience applied for subsidy loan of 50 lakhs from the government and it was sanctioned, to utilise this loan needed security and requested to my father, he dint support!

My father never earned any asset, never supported for family, his lakhs of monthly salary, his lakhs of retirement benefits and lakhs of money from sold properties no one knows where it gone, he is paying about a lakh as interest for his loans even today! To compensate this secret, he is saying to all our relatives, that he spent for my pilot training course! Doubting on his activities, I have enquired with his close friend who is a lawyer and come to know that he is a gambler!

No support for the family, no wealth creation, still paying interests for loans after retirement! Not supporting in any serious situation of mine! With my wife's only support and not to waste the taxpayer's money, I came back to complete the pilot course, here starts the next trouble, my flight classes which i have completed already is valid for 5 years and it is expired now, to compensate the expired flight classes, I needed 10 lakhs and explained to my aviation knowledge less father, he is not supporting!

Now I don't have any option, kindly suggest me that do i have rights in my Grandfather's property which is in my father's name currently, if i have, i wanted to claim it and need to complete the course and free my struggling wife and save my family! Am planning to file a suit based on the situation explained above, what would be the advice??

refund of enhancement paid to huda

Dear Experts
I want to know about refund policy of huda in matter of enhancement cost paid by allottee to huda.
If anyone transfer/sell their huda plot and after some time huda issue refund on that enhancement
who is eligible to get refund amount present alllotte or previous allotte who paid that amount.

Regarding address of buyer and seller

Any sale deed is not valid until it carries the names of both the parties in their relevant places – as seller and buyer or lessee and lessor.
is it true ?
a person is done fraud with us, case is already running in court we came to know that the address written by buyer in a sale deed was not the right present address he is living in right now and at the time of sale deed, he is sifted to another address. how ever adhar card , id proof is of same address which was written in the sale deed. sale deed was done by fraud the seller was in impression that he was signing the mortgage paper against the loan he takes on property in question

Address of buyer or seller is not right

My query is if a sale deed is registered in a sub regesterar office and Buyer gives the wrong address
adhar card is off same address but the buyer shifted to some other address before the deed than there is any issue in case any fraud is happened in the deed. in case of any dispute.

Objection letter Sub registrar - Injunction Order

Dear Experts,
There is a property in the name of my grand mother, I'm the legal ancestor after the expiry of my grand father (as my father expired), but elder son (my father's brother) forcing my grand mother to transfer the whole property in the name of him

I approached sub-registrar with written complaint on paper to stop registration if they approaches in future, but registrar not accepted instead he asked us to get Injunction Order from the Court.

Can i get Injunction Order for the above reason?

How much time it will take to get injunction order?

How much approx cost (including professional fee+Court fee+ others) ,I should incur for injunction order?

Is there any alternative to stop registration other than injunction order

Legal heir issue

Hello sir myself Ejas from Telangana I purchased one empty land from one person.he purchased long back from another person who was expired recently..Now I want to construct home in that land but I can't getting Bank loan due to legalheir certificate how could I get now cause he doesn't have children....Please suggest me a solution

Buying a property without legal heir certificate

Hi All

I'm planning to buy a property with below background.

1. Property was registered to person A [first owner] on year of 1953.

2. Person A died around year 1990 - and there was no will on this property at the time of his demise.

3. Person A had 2 wives...and his second wife did not have any children.

4. But with first wife he had two daughters [C & D] . second wife do not have any children.

5. First daughter "C" - passed away somewhere around year 2000.

6. In the year of 2007 - Children of first daughter "C" [two daughters and a son] and second daughter "D" given general power to person B after receiving 2.5k Lacs; i assume they given "power of attroney" to B. the power document states that person B owns a power to sell, maintain.

I assume they sold the property to person B...

7. There is no legal heir certificate for two daughters C & D. ANd there is no death certificate of Person A and Daughter C.

Now can i buy this property from person B?

will i face any legal consequences from heir of daughters C & D?

Do i face ay issue in getting loan from banks to renovate the property if i buy this?

Can daughters challenge the will and claim an equal share?

We are a goan family and our father inherited a property from his father in Goa. We are three sisters and one brother.
Now, the property constitutes of a house and land. The major share of the house and land has been willed to my brother. My brother has also been willed a house & land in another state as well while we sisters have got small portions of land in both places. My brother is unable to maintain the house and our portion of the land is unusable hence we suggested to sell the entire property but he is not in favor of that.
- According to the prevalent Goan law, as daughters could we challenge the will and claim an equal share in the entire property?

Also, the Form I & IV is in the name of my grandfather and father who are deceased. While my father was alive, his brothers and sisters surrendered their share in the form of gift deeds in favor of my father.
- What is the process of deleting my grandfather & father's name from Form I & IV and adding our (3 siters and 1 brother) names in it?

- Lastly, can our cousins claim a share in the property in spite of their parents surrendering thier share in favor of my father?

Transfer fees

Hi,I bought one flat 2 years back .In sale agreement there was one clause stating clearly "seller is liable to pay any maintaince dues,electricity and transfer fees to society".After we entered our new home ,Builder left society and we came to know that he handed all reponsiblity of society to a local man who reside in our society and is also a agent.
After few months ,That guy started managing responsiblity of society like water ,maintenance other stuffs.He also starting selling flats that were unsold before builder left.
Now he is demanding transfer fees from us.What should i do in this case.I had already showed him my sale agreemnet that seller is liable to pay transfer fees because we had that in clause of agreement.Seller is no more in this city and neither he is picking call.What legal actions should i do because that guy whom builder had handed over society is threatening to stop our water faclities. even if i am paying maintenence fess of society from last 2 years.
Please solve my problem with legal solution
1.Am i eligible to pay transfer Fees?
2.If yes then whom should i pay,Builder is nowhere and that guy dont have any proof of his position if he is chairman or secretary
3.If the seller is liable to pay and he is not available what should i do
4.Guy is threatening to stop our water and electricity connection can i take a legal action against him..even if i am eligible to pay transfer fees?
5.What documents should i demand to know that guy is real responsible person(chairman/secretary) of society
