provision in Land Acquisition Act of 1894

Is there a procedure specified in the Land Acquisition Act of 1894 about the LAO coordinating with the Registrar of Deeds after an Acquisition has been made or
about how the title of the acquired land is changed from the landowner to the State and at what point of time in the process of acquisition. Kindly explain.

Need Advise

Sir,
I have planned to buy a plot in a gated community in Hennur Road, Bangalore. The Layout is approved by Gram Panchyat in Dec2009. The layout is under BBMP and the developer has obtained BBMP Khata for the entire layout. Also,layout is DC converted with BDA NOC. I have couple of questions to ask
1. Is is safe to buy such a site.
2. Can gram panchyat approve layout which is under BBMP
3. Will bank give loan to such sites?
4. Will I get a BBMP individual Khata later?
5. Should I pay any betterment charges?
6. The family tree is signed by a notary. Does this hold good as I heard it should be given by Gram Panchayat office.

On legal aspects, the entire layout is formed on 2.6 acres and shared among six brothers. These brothers have given irrecoverable GPA(registered) to one of the brother to sell sites formed in the layout. My concern is that the brothers who have signed GPA have minor sons & daughters. Can this be an issue for me to buy?can these children file a suite. Earlier ,this property was bought by father of six brothers.

booking a flat in a society

Can I book a flat in some auto society? I am not working with this company/field.

Normally, an afidavit has to be signed to declear that you are working in same company/field. Right? Is it must?

Can society flat be sold at any time or it can't be sold till some period after completion/possession?

Sell of independant floors on unapproved plan

I booked a flat in a project ERA devine court of ERA group in faridabad Sector 76 on 5th OCT 2009. The project was sold out on layout plan of the society showing all features of the project like your flat number, its location, dimension, parking space and other things.
later when laon was applied against this property it was revealed that this project does not have approval of HUDA authorities and disbusment is not possible.
Now builder is started work at sight and has changed the complete layout plan at his own. He has constructed the additional flats on the space shown as greenery and parks. The size of flats has been reduced by 15 percent. There is no approval of this project as yet. The motive of booking a home is completely defeated. Neither builder refunding the money nor providing any details about approval. Local authorities are in picture but reluctant to listed against him.
What can be done in this regard to recover my hard earned money. He is asking for further payment and to accept the flat what is being constructed with out any approval.
please suggest actions which can be taken in this regard.
What could be done to come out from the loss

Please let me know how much the stamp duty i have to pay for the flat having value of 3/- lac ?

what is the procedure of registration sale deed & how much total expense incurre including all expense from making stamp paper to lawyers fee?

NEW APARTMENT MAINTENANCE EXPENSE

I am from gujarat i bought new flat in apartment where there is 9 others flat holder is there we want to form society to manage building maintenance funds (1) please let us know which procedure required to form society (2)what is advantage to form society to manage this kind of multiowner funds? is it safer than any other way to manage funds?

Giving under construction property to my wife

I booked a commercial property on my name. The property is under construction. Possession has not been given by the builder yet.

How can I give this property to my wife? Objective is to make my wife the owner of the property. I don't want to own it.

Gift deed?
Relinquishment deed?
Transfer?

Should this arrangement be done with the builder or at registrar or in court?

Builder is charging extra money per square foot for transfer.

Is relinquishment deed, which costs much less, applicable/possible in this case?

share to Daughter from father property

If the father has 2 wifes and 1 dead (has 1 son) - 1 alive (has 2 children - 1 male and 1 female).

If father has made the entire property in the name of the 2nd wife.

Does 1st wife son and 2nd wife daughter gets the property share by succession.

conveyance

Hi all, i have purchased a resale flat where society conveyance is not given by builder because he still has not sold one of the flats in the society. building was constructed 5 yrs back. pls let me know whether in this case, can conveyance be obtained from builders and if so, on what basis. thanks.
