Regarding flat & NPA account

I had taken a home loan for a flat in Mira Road of 3 Lacs from LIC Housing Finance . For some reason I could not pay the instalments .To avoid account turning NPA I handed over the said flat who was interested in purchasing on loan . But since his IT papers were not ready he could not get the loan . Meanwhile he paid me Rs. 50000/- . I hasd handed over the possession of said flat on the terms that my friend would continue paying the installaments in my name till he can take over the loan . To this effect I had handed over him the said flat under Power of Attorney registered with registrar to this effect. On POA it does not reflect as sale of the flat . It is as if he is a care taker & can attend the proceedings if any on my behalf pertaining to the flat. But it so happened that even he did not pay the installements & account turned NPA . LIC has sealed the flat & taken over the possession & inturn has been sold somebody else. All this time I was away from Bombay not aware of the proceedings .
Now that some one else is occupying the said flat The span of NPA is 4 yrs. So can the instution sell out on their own the flat. Can any further claim be made on me. can I get back the valuable belongings that were locked & transferred in my absence. More so can the institution intitate any Cr. Proceedins against me.
Should I go the bank & tell that I am ready to pay the outstanding in one stroke I may be given my flat back .The proprty value has risen in this 4 yrs.
I dont know whether any notices have been served to my gurantors or not as they are not staying at their place.the 3rd gurantor has ot recived any one of such notice. Nor I have got any intimation about the same.
Can LIC with the help of my gurantors would have sold the property. There were 3 guarantors . My suspect is that out of those 3, 2 would have helped LIC in sale proceedings as they were agents who used to get the LIC loan processed for the flat. One guarantor was from MTNL But he did not receive any notice regarding any recalling or any proceedings if done so. P
Pls advice me as to should I go to LIC & ask them for a Final settlement to paid in one sroke. Can they arrest me on this count of non payment. Or what is the next step that I should take so that I can get back my flat.

Can a partition deed signed by a father on behalf of his minors hold good?

In 1952, a Hindu Grand father signed and registered a partition deed between his brothers but it also stated in one of the clause that his wife and minor daughters will not have any rights on the ancestral property that the joint faimily has recieved as a result of the deed.
The deed stated that the rights will only be of the male members(himself and his son), but subject to the right of the women under the Hindu Law.

Would this deed mean that the property rights of the daughters are alienated and they would not be able to claim the coparcenary rights on this property after the 2005 amendment?

To be noted is that it was a ancestral property.
The deed was done before 1956.
The daughters and the son were all minors. The deed was duly registered.
Daughers claimed thier rights only in 2009 as they were not aware of the deed.

Is awarneess required?

How does one interprete "subject to the rights of the women under the Hindu law"? and what is the ramification?

daughter's right to father's property

Can someone kindly enlighten me on the folowing?

what was the law/Act prevailing before 1956 with reagard to right of daughters in father's intestate property?
Some say daughters had equal right in father's intestate property and some say daughters's could get only 1/4 th of sons share or Rs5000/- whichever is less as per Sucession Act,1925?

if it is equal share under whcih law/ Act existing prior to 1956 and under which section it is stated so?

If both are incorrect which was the applicable law/Act and what does it sstate?

can a landlord lock a tenant's shop

My grandfather made an agreement with our tenant about 40 years back to let out our shop which is now in a very upmarket locality of Bangalore city. The tenant has been paying rent regularly which is a meagre Rs 1,500/ whereas the prevailing rental in the locality is more than Rs 20,000/ per month. He had kept the shop shut for the past few months. One fine morning I suddenly saw the shop open with new interiors and products, then I realised he has sub let the shop. In a fit of rage, I chased out the employees and put my locks on the shop. Then the tenant came to talk & I refused to open the shop saying, he has to cancel the sub lease and increase the rent to atleast 50% of market rate that is Rs 10,000/ per month. He flatly refused to increase the rent and says that he has not sub let the shop and challenges me to prove it. I still have not opened the shop, but he is frequently threatening me that he will take some kind of action. I have made my stand clear that only if the 2 conditions are met, I will open the shop. I would like to know what action he can take and how I can defend myself. Thanks
