I HAVE A DOUBT IN MIND N I NEED UR HELP TO SORT IT OUT ENHANCE MY KNOWLEDGE OF LAW AS I M A LAW STUDENT.


'A'-'B'-'C' ARE PARTNER IN A FIRM
(a)B & C ARE HUSBAND N WIFE
(b)A IS A NRI

'B' WANTS TO RETIRE. N ACTIONS THERE SHARE OF PROPERTY OF THE FIRM.

A's MOM LANDS MONEY TO SUM FAMILY MEMBER 'X' AS LOAN/GIFT OUT OF MONEY THAT SHE HAS RECIEVED FROM SUM NRI,
THAN 'X' BUYS THAT AUCTION PROPERTY FOR HIMSELF.

IF A's MOM GIVES MONEY AS LOAN SHE DECIDES NOT TO TAKE ANY INTEREST AS 'X' IS A FAMILY MEMBER.

AFTER A 1YEAR 'X' PAYS BACK THE LOAN TO A's MOM.

AND MEANWHILE AFTER REPAYING SELLS THE PROPERTY TO SUMOTHER FIRM IN WHICH A's MOM IS PARTNER.

QUESTION::

1)IS IT LEGAL?

2)IF NOT UNDER THE PREVIEW OF WHICH ACT DOES THIS FALL?

3)CAN 'X'SELL PROPERTY TO FIRM IN WHICH A'S MOM IS PARTNER COZ SHE HAD GIVEN HIM LOAN/GIFT?

4)THIS FIRM IS THE SAME ACTIONED FIRM IN WHICH A'S SON 'A' IS A PARTNER,SO HOW DOES IT AFFECT 'A'?

5)DO LATEST PROVISION OF STAMP DUTY ACT,IT ACT ARE TAKEN CARE OFF?

6)AND LATER WHAT IF A's MOM WISHES TO TRANSFER THE SAME PROPERTY TO 'A' IN LATER YEARS,CAN A TAKE THAT ? BEING N NRI LATER CAN HE MAKE IT A PRIVATE LIMITED FIRM IN INDIA?

If anyone knows, could you please tell be when the Bata Dag was system introduced in West Bengal, more specifically in Calcutta.

suit for specific performance

If the plaintiff who is the buyer of the property(a house) the cosideration value of which is 50 lac pays 30 lac as earnest money and the seller refuses to appear for the registry of the property. A suit for specific performance is filed and the plaitiff wins say after 4 years. Can he claim interest on Rs. 30 lac which had been lying with the seller(defendent) for four years or can he claim the rent of the property from the agreed date of registry till the final judgment?

Sir don't you think that this goes to seller's advantage. He can file the aapeal and can delay the justice for many many years. Some remedy should be there in case it is proved that the defendent was wilfully delaying the registry and the possesion of the property

Form a Association

Is't possible to formmed a flat-owners’ association Without informing to the Promoter,but in the agrement/Regestri it is written that Promoter can only form the association within one year of the delivery of possition 80% of units in the building complex or if so decided by the promoters the association will be formed to take over the control for common purpose only.

Registration.


I have got property in Sindhudurg Dist Maharashtra. I have to give some part of my room on Leave and License basis on nominal compensation of Rs. 1500/- I have prepared Leave and License agreement. I would like to know that Registration is necessary and if it necessary How much I have to pay the registration charges?

Please advise.

Threating

Dear Expert,

We are having 400 square yard house and my mother had divided the house in three equal parts among we three brothers and i am the Seconal son to my mother and my mother lives with me, my father had expired in 2004.

Now my brothers wants partition deed so that they can sell and go away from the house, they never takes responsibility of taking care of my mother.

Daily now their are threating me to sign the partition papers are else their were going to occupy my portion also, thing is i dont like to sign the papers because i love my house and it was built by my father and my self with lot of pain, all family members can live comfortably.

My mother is in dilemma and not able to tell any think to them, and her health is spoiling day by day due to tensions of the house.

So please inform me how to stop my brothers
attitude of threating me and to stop occupying my portion.

acquisition of government land

the local municipality proposes to acquire land belonging to the railways for the purposes of road widening. Since land acquisition act is not applicable to the said acquisition how to determine the market value and also let me know how is the market value of government land determined.

Flat ownership

Hi,

I had purchased a flat in a registered GHS. However, due to litigation against the tri-partite agreement between GHS and government, the original allotee had not registered the flat to his name. The flat was sold purely based on allotment change by GHS to the next buyer and then to me. The flat has till date not been registered to anybody.

Now the litigation is over and the registry is open however, the gov officials say that the registration of the first allotee is necessary. The original allotee is not cooperative and refuses to register the property to his name or to my name. The intermediate owner is dead.

Kindly advise me what can be done. I am even willing to pay for the registration charge of all the parties. Can I get the flat registered directly to my name.

The change of allotment letter to my name is the only ownership document that I have.
Kindly help.
