My father passed away recently.He has two house property in his name, the only legal heis are my mother, my brother and myself. My mother wants these two properties to be transferd to my brother and my self rerspectively. I would like to know wheather we can do it by incoparating a partition deed . kindly advice. if so, can i transfer the khatha to my name after the registration of deed.

I am looking to buy a residential unit. The seller will sale the ground floor and will construct a floor in the roof. The approach road of that flat is maintained privately by the owner of the said building with other two owners of separate building. Seller is of the view that he will mention in the deed of sale for transfer his share use of approach road and hence there is no requirement of getting permission from the other two co-owners anything for this. One of our member pointed that as a buyer i need to take the permission from the other two owners also. Now
my question the word "permission" is of no meaning unless legalised which can only be possible by executing separate deed. Am i correct?
Does the seller can exercise such right without a prior permission from the co-owners? Please give your expert views. As a buyer i am having some tension over here.
Q. A has taken a premises on lease for a period of Nine years from B. A has entered into a lease agreement with B on 25th may 2011 and subsequently taken the possession of the premises on 04th may 2011. But due to some reasons, the above said Agreement was not registered at the time of its exeuction and the same is presented for registration on 17th June 2011.
What would be the commencement date of the lease?
a. Execution Date (signing date of the lease);
B. Possession date;
C. Registration Date;
D. Lease rental commencing Date.

Dear sir,
I belongs to karnataka- I have grand father proeprties which were divided in to my slef and my father.(He passed away in the year 2007)he had one son and three daughter-In which 2 daugher were married in 1985 and 1990 ,
1.According to karnataka act of 1994 which clearly states that daughter who have married before 1994 they can't calim their rights in ancester property's?
2.My second sister were married in 1998.
3.She is already file the suit for partition in 20/8/2005 what can be the result and how long will it take?
4.She will getting equal share with me or less?
5.She have share in landed house or not?

Sir,
I am going to buy a residential unit. The seller had given the photocopy of the title deed, sanctioned plan, municipal tax receipt and he wants to assure for a token advance of Rs 5000/- say for safeguard for the property deal which is adjustable against subsequent final payment. I have no objection also for making the payment but i want to make sure what should be the form of payment.
a. Definitely through cheque
b. Whether for this a non judicial stamp detailing such advance would be required?

Can Residential property (LAND) be mortgaged on the basis of power of attorny ?
Plz help sir!
I have a property here in Jalandhar(Punjab) against which i want to take loan from bank as mortgage. There has been no registry of the property and i have TS1 certificate issued by the Municipal Corporation as the only document showing my ownership on the property.
Plz tell me is the TS1 certificate sufficient document for getting loan from bank?

I heard that the Hon'ble Supreme Court gave decision that there are no rights on cellar parking or terrace usage by the builder for giving lease/sale. If it is there pl give the SC ruling No. & date. Pl clarify. Thank you.
