Dear All,
what is the value of a notorized document?
is it binding on the signing and executing parties?
what is the evidentiary value of the same?
can we issue NOC for transfering the property in which we have right, by merely executing consent letter and notorizing same.? is it binding on us?

Hello,
My husband has recently purchased a flat in mumbai in Joint names with his mother( His name being the first name). This I understand was due to his parents being the major contributor for purchase of the flat and also because my husband could get tax benefit on interest on housing loan, thus he was for namesake made a first namement for the flat.I would like to know-
1) If something untowards would happen to my husband, will I get a claim in the joint property if I were not to remarry( presently we have no children at present)
2)and the case if I were to remarry with us having a child.

Ms. A gives the property to Mr. B in the year 1985 in consideration of love and affection. Both A & B are Hindu. A never made any gift deed in favor of B. A died after some period of time of this gift and leaving behind 2 daughters. Now in 2011 onwards the heirs of Ms. A want this house for their use and harassing B and their family members to leave this property. They even send the notice under which they are considering b as a tenant.
Now the question is that can B go for the suit of adverse possession OR B may go for “ORAL GIFT?

My Company was taken office accommodation on lease rental basis. In that flat more than one occupants. According to the lease agreement maintenance charges has to beared by the all the occupants. From the begining the common maintenance charges charged acording to the actual basis. No they want to charge on lump sum basis according to their calculation and it is coming more 2 times than the earlier bills. They gave explanation that so many charges earlier they have not charged like salary of the attendant, bore well repair chrges, lift annual repair charges (although in the lease agreement details of common maintenance charges has not explained)now they are charging from current month.
My query is what are all expenditure will come under common maintenance charges i.e what are all owner has to bear and what are all occupants will bear.
We requested them the details of amount paid on actual basis but they are not willing to provide that. we sent email until the details of expenditure we get we will not pay lumpsum basis. can we do so?what are remedy available under Consumer Protection Act?

Housing Federation By-laws.
Dear Sir,
I stay in Lokgram Complex, developed by M/s.Lok Developers of 23 Buildings of individual societies & one common FEDERATION (society) to look after overall maintananic of the complex.
The Federation election is to be held on 31.07.2010. The notice of the same issued on 03.07.10 stating that the outstanding payments to be made on or before 10.07.11 otherwise defaulter society shall be restricted for candidate nomination and voting for election.
My question - Is federation have this right to restrict society for nomination candidate and voting? because they have issued the notice on 03.07.11 & last due date was 10.07.11 which is very short period for societies to take decision and release payments.
2) Can we postpond the election?
3) How many times / Years one candidate is eligible to participate for election?
4)Is the bylaws for federation is different than Bylaws applicable to co-op societies?
5)As per Federation Bylaws the Capital shows Rs.10 Lacs i.e 10000 shares X Rs.100/ each, where as our balance sheet shows Rs.100000/- capital - How it is?
Please reply at the earliest.
