Claim half of the property

Husband and wife are working. Both take action and purchased a plot and construct the house. Property was purchased after the marriage and was registered on husband name.
wife & husband are not in good terms now, but they aren't living together, there is no divorce, planning for divorce)
Further, the land was purchased by pleadging wife jewels, by bank loan of both and savings of LIC of both and wife is the co-applicant for the Home loan. And necessary permission was obtained by the department and the pleadging of jewels details was entered in the registered document.
Husband accept to give half of the share through gift deed.
Whether the problem can be solved by way of gift deed or it can be done by other way of mode. please explain in detail.
And whether the wording (ie. without the knowledge of the wife the property could not be saled) can be used in that
please explain in detail.

Tenancy by holding over

Respected experts, If a lease period expires and if the tenant has not vacated the premise and also not given the rent for those months after the lease period, what action can the landlord take against him under law? I think the lease becomes tenancy by holding over. I want to know the rights of the land lord at such circumstances. Whether he has to send legal notice for eviction, and what about the arrears of rent payable?

Civil suit after the partition and sale deed

Father received some immovable property from our grandfather by way of registered partition deed in 1971.

now our father has two sons and three daughters.

our father has sold some properties in 2002 and 2005 by registered sale deed alongwith his two sons only excluding the his three own daughters.

in 2006 our father and we two sons have paid rs. 50,000/- to each sisters and have not taken any NOC. Later our father has made a registered partition deed among himself and his two sons only. all the sisters were quite happy.

in 2008 one of the son has sold his share/property by way of registered sale deed to third person due to his requirement.

in 2010 two sisters has moved to court and challenged a civil suit partition against our father, two brothers and the third party buyer also.

please let me know your valuable suggestions how to overcome by this civil suit partition.

Invalid nomination

Dear Sirs,

My mother owns a Flat in Mumbai as a First Holder along with my Father (seocnd holder) and myslef (Third Holder). My Father (Second Holder) died during 2008 and my Mother (First Holder) died during June 2011. I am the only sole legal heir of my deceased mother and father.

My Mother has made a nomination during 2000, which has been recorded by the society. But the said nomination form has found with following defects:

1) Signature of my mother on nomination is in English while in Agreement it is in Gujrati Language.

2) Nomination has been made in favour of my daughter who is a minor till now. However, there is no mention of any Guardian name in the Nomination Form.

Even then, society has recorded the said Nomination in it's register.

Now society is asking me to submit Succession Certificate, Indemnity Bond, Appendix 3, Appendix 4 and Appendix 15 and ULC Undertaking.

Is the society demand od Succession certificate and other documents is reasonable. If is not, what is the remady available to me for the transfer of the flat in my name if society does not co-operate me in this regard.

Please Advise.

Thanks.

Tokan gave to owner, not ready to sale now.

Hi Sir/madam,
I was done deal for flat at 28.5lakhs for 2 bhk in end of April’2011 month.
I gave 50,000/- cheque as token amount to owner in first week of may month.

But flat is owned by husband & wife. Husband is out of India for next 6 months.
So owner parties told me, can you wait for 6-7 month? If your wait for next 6-7 month then we accept token amount.

I told them, I am ready to wait for 6-7 month or more...
Because flat registered on husband & wife, so for registration & agreement , both are required. i gave token 50000/- as cheque.

I don’t make MOU with them. My mistake.
they said, believe on us. we are not break your trust.

I was wait for him.

Now I proceed for home loan, arrange all down payment from families, relative.

On 15th August 2011, they said, we are not ready for sale flat. Please cancel deal.
Reason---- they got enough amount from relative to pay new flat’s loan.

Please advise me, what I will do now? I wait for 6 months, paid my rent for current flat, price is hike more.
I am frustrate from cancelling deal. But I want to buy same flat. Because I am waiting from 6 month.

Regards
Bapu
