A property was purchased by sex partners in 1973. A partnership firm was registered in 1974 to govern and manage the property. The property is in maharashtra state. A POA was issued by 4 partners to the 5th partner in 1989 which is a general POA but also includes rights to find customers, decide price and sale the property. But the POA was only magistrate attested and not registered. Now the 5th partner and 6th partner sold the property to a company where the owners are sons and wife of 5th partner and the 6 th partner himself. They sold the property in 2008 and sold it at a price 95% less than ready reckoner rate. Also the POA is not registered and not used in sale deed. In the sale deed the 5th partner is standing as seller and 6th partner as buyer. It is mentioned as 5th partner is selling " duly authorised by resoltuion Dated : .... " but the other 4 partners have not given any reslolution nor have signed on it. What legal action should i take. and what are my chances.

I am a Jr. Advocate.
I have referred with a query to search the title of the flat.
The flat is financed by Bank. Bank is having registered Sale Deed and NOC of the Builder with them as they have created mortgage Deed.
Now it is learnt by the officials of the Bank that borrower has cheated various banks by forging the documents.. now builder is also absconding and not in place. There is no society registered.
Kindly guide that from where I can get appropriate information about the exact title and charges created over the flat.
Kindly guide and help..
Thanking you in anticipation.

Sir,
I have purchased an apartment and going to register it in Gaya (Bihar). Now Govt rate is more than the purchased rate and they are also charging registration fee on the undivided share of land. Whether stamp duty is payable on land also after paying for super built up area.
Regards Sanjeet

I was a employee of a Pvt. Ltd. company that went into liquidation in 1982. Employees salary, funds, gratuity, insurance remain unpaid even today. In my case it comes to over Rs. 7 Lacs as in 1982. Some executives like me were alloted residential accomodation which are still under our occupation while almost all the assets have been disposed surprisingly the said properties in occupation of few executives have not been attached.
My question is (One) what are the laws governing liquidation of assets can the residence under my occupation for which I have been paying all dues for the last 29 years can be ceased or attached. (Two) What is the legal procedure to officially take cutody of the said premises and become its lawfull owner.

I had booked a flat and builder is asking for parking and facilities charges as per the allotment letter.
i recently come to know that builder can't charge for parking and facilities, according to SC judgment (SEP 2010).
Please guide me and let me have the judgment.

Sir,
A residential flat in Mumbai is to be transefered from Mother to son, from the point of lesser stamp duty and registration fees what will be a better option to prepare a transfer deed or to prepare a gift deed.
Thanks

Hi Experts,
My friend had purchased a site(revenue) in 2004 & has since paid all taxes towards the same.
Around 2009 to the sellers have colluded with their sisters & filed a partition suit claiming 1/7th share for the entire layout. Since the case is in court, my friend & 20 other site purchasers are being harrassed.
Police have refused to register a case, suggesting us to fight it out in court.
Can we file a criminal complaint revelvant provisions for Cheating, Criminal conspiracy by the sellers family to defaud inocent purchasers like by friend.
Your advise will be deeply appreciated.
Strange case of a will
This is a very strange case of a person who executed two wills and am posting this here for discussion. 'A' executed a WILL in 2000 bequeathing his property to his Wife. This will of 2000 was properly registered in presence of witnesses, the testator 'A' and medical doctor . Later in 2006 just before his death he revoked his will of 2000 and executed another WILL mostly identical to the WILL of 2000 but this time he mentioned of the earlier WILL of 2000 and that he was revoking it and freshly bequeathed his property to his daughter. This WILL was executed in presence of witnesses but not registered and without a doctor's certificate. Now the latest WILL carried a clause that the WILL will be enforced 4 years after the testator's death. Now both the wife and daughter of the testator have two wills and wish to proceed to stake claim on the property. Now what is strange is that the wife who held the earlier WILL never shared this information with the daughter and never attempted to get the WILL executed for mutation or change in ownership of property after the death of the testator in 2006 till todate. Under such situation what are the chances of the daughter vis-a-vis to the wife in such scenario. Opinion could be posted.
