Immovable property

sir,
i have a number of cases related to land with different parties( title suits, complain cases etc).the problem is that my all 4 brothers and my cousin brothers too are not co-operating.that is to say only i am looking after all the cases like giving time for the cases and also i am only the one who is spending money in the cases like paying advocate, court fees etc.since the number of cases is around 40 in numbers due to which i have to give almost everyday for contesting the cases.still the partition between our uncles has not taken place. now if i just get out for earning money then whole of our property is going to be lost coz is no one is going to give time in court.now when the cases will be concluded in the future they will get equal share to me.then what about my spending money and time which i lost in court..what should i do so that i get greater share as i have invested my time and money over the years..do i send them notice that they are not spending money so they are not going to get share..

Expert guidance

sjt.
namaste.

regret to disturb and thanking you in anticipation for your guidance.

in redevelopment, a flat has been allocated in exchaange of two tenancy right of two flats belonging to my father & grandpa respectively.

grandpa has filed a suit & rejoinder against builder in which he tries to project himself as KARTA of JOINT FAMILY with supporting documents belonging to him only.

like to know by filing the suit & Rejoinder as KARTA of JOINT FAMILY and not joint/co-owner of flat,

does this flat automatically become an JOINT FAMILY / HUF property ?

as a necessary party, if my father will have to join later
then

will it automatically mean it is my father's mutual consent/willingness to term this flat as JOINT FAMILY / HUF property ?

then what is position of present INDIVIDUAL SHARE of my father ?

regards.

Cross examination

A PERSON HAS FILED A SUIT FOR SPECIFIC PERFORMANCE ON THE BASIS OF A PHOTOCOPIED AGREEMENT AND A RECIEPT IN ORIGINAL . THE AGREEMENT HAS BEEN DENIED BY ME . THE CBI CFSL HAS DECLARED THE RECEIPT AS FORGED DOCUMENT . THE PLAINTIFF HAS SHOWN HIS SON AS THE ATTESTING WITNESS ON THE FORGED RECEIPT AND PHOTOCOPIED FORGED AGREEMENT . NOW MY QUERY IS THAT I WANT TO CROSS EXAMINE BOTH THE PLAINTIFF AND HIS SON IN THE COURT ON THE SAME SAME DAY . PREFEREBLY THE SON FIRST AND SIMULATEAOUSLY THE PLAINTIFF . IS THEREF ANY PROVISION IN THE LAW UN DER WHICH I CAN COMPEL THE PLAINTIFF AND HIS SON ( WITNESS ) TO BE CROSS EXAMINED ON THE SAME DAY . MY LAWYER IS SAYING THAT I CANNOT COMPEL THE PLAINTIFF TO BRING HIM SELF AND HIS SON FOR CROSS ON SAME SAY. FURTHER IF THE BOTH THE PLAINTIF AND HIS SON WHO IS THE ATTESTING WITNESS ARE NOT EXAMINED ON THE SAME DAY MY CASE WILL SUFFER VERY MUCH AS TRUTH AND FORGERY COMMITTED BY THE PLAINTIFF AND HIS SON MAY NOT COME OUT . Ptcl land transfered in 1972 - now it is layout with 65 residents

Dear sir,

2 acres of land granted to SC/ST, we son't have grant copy and it is claimed in the sale deed that it is lost, but granted in the year 1939 (ref no is available).

grantee has sold this to our layout developer in the year 1972 without availing any permission from state govt. once PTCL has come, grantee has gone to AC for appeal for restoration but AC has denied because 15 years of restriction period is lapsed.

this land has converted in the year 2003 and formed layout with panchayat approval. now we have katha and paying taxes regularly.

at the time of purchase i was not aware about writ pending in the high court, writ filed in the year 2004. developer has not turned up because he had sold entire plots and now more than 50% houses also built.

high court has order for restoration, whether we have any grounds for appeal as a resident and whether we will successful.

judge is referring mysore land revenue act 1988, as transfer of granted land to depressed class is prohibited forever.this order is passed on 4th july 2011 by karnataka high court judge me. shylesh.

can you suggest us any case law to support us?

regards,

In the month of august 2011,the person X entered into my flat "A" forcefully by breaking the lock BUT I came to know about it few days back of this month about it and also i have not lodged any complint in the police. Now because of such behaviour now I dont want to sell my flat "A" to X although the person X is ready to pay the money agreed in the MOU.I am also ready to return their token money but i will not sell my FLAT to such person.please suggest me .
