Agreement to sale

Mr. A (seller) has executed an agreement to sale with Mr. B (buyer). Mr A received 1,50,000 from Mr. B and remaining amount will paid on or before 15 july 2011 by Mr. B at the time of registry. This Agreement to sale mentioned that Mr. A will not forfeit Rs. 1,50,000 if Mr. B shows is unwillingness to buy the property. Also, Mr. B will not ask any interest amount if Mr. A shows their unwillingness. Both this condition is silent as far as the time is concern but the agreement only mention the validity of time for registration and remaining amount i.e 15 july 2011. Now this period has passed and its a November month and Mr. B has not yet come to Mr. A for remaining amount as well as for registration. Still the possession is with Mr. A. Now what Mr. A has to do in this situation? Should he send the notice to Mr. B stating that if Mr. B will not come within one week than Mr. A will forfeit his money and the agreement will be cancelled?

Is there is law for all flat reg. under co.op. soc. or ntc

when builder sales all flats. normally all a/c, admn. work hand over to flat owners co. op. soc., or ntc.

I like to know it is compolsory to make co. op. soc, or ntc by law in Gujarat, or India.

if yes I like to know what is law and who is authority for procedure?

and if there is 22 years old flats in which no soc. or ntc registered is there any problem ?

if its not compolsory to make co. op. soc., in revenue records like 7/12 etc.. there is the name of builders. so he has the right or not to sale terrace, or land of holo plinth area?

Lok adalat power deciding bonafide of title if both parties agreed

If one of the party made application to district legal service authority to dissolve their legal problem & district legal service authority referred that case to lokadalat since case involves prelitigant & if both parties agreed before Lokadalat that they stand & obey the final award made by Lokadalat for conclusions on title declaration which is in dispute by putting terms of condition that one of the party who got the title will pay amount of 20% of market value to other Lost party.
1)since both party jointly put terms of comperomise condition that they obey conclusions of Lokadalat & they settle amount,In this situation whether LOKAdalat has judicial power to proceed which party had right title with available evidence& make conclusions on bonafide of Title which is in dispute

Pls suggest alternatives available to acquire our portion of house as per will

Hi

First i would like to tell you the family structure. My grand father has 6 sons & 3 daughters. My father is 2nd eldest son. My grand father has one house in delhi with 3 floors including ground. He called my dad to write his will as he had maximum trust on my dad. According to the will, house is divided between his three sons, i.e. ground floor to my dad , 1st floor 2 his 5th son & 3rd floor to 6th son. Rest sons were given shops. That will has signature of my grand father, 2 withness which is my nanaji n my dad'z frnd. This will was made 40 yrs back & after 1 yr of the will, my grand father passed away. Even after few yrs my grand mother & nanaji, who withnessed the will also passed away. But that will does not have signature of any sons & daughter of my grand father. 40 yrs back my dad had his job in lucknow. so, he shifted there and constructed his own house there. For the time being he gave his ground floor portion to this 4th no. brother to live as he has no house & no son. My dad thought, there would be no compulsary acqusition of his portion as he has no son. But his 4th n 5th no. brother joined hands together & they are not ready to leave the house. The 5th no. brother has one son & has own 2 houses. He is greedy & says that 'will' is fake. He has power & money. He feels if we are going to take any action then he will prove the will fake as it does not have signature of all sons & daughter.
As we are thinking to shift in delhi & want our house back. Please suggest me what can i do in this case. Even one witness is alive. We want to take an action as soon as possible as he is aged. Even 3 owners of the house as per the will including my dad is paying property tax since 40yrs.
pls pls suggest me, so that i can help my dad.
