when builder sales all flats. normally all a/c, admn. work hand over to flat owners co. op. soc., or ntc.
I like to know it is compolsory to make co. op. soc, or ntc by law in Gujarat, or India.
if yes I like to know what is law and who is authority for procedure?
and if there is 22 years old flats in which no soc. or ntc registered is there any problem ?
if its not compolsory to make co. op. soc., in revenue records like 7/12 etc.. there is the name of builders. so he has the right or not to sale terrace, or land of holo plinth area?

in maharashtra we have maharashtra cooperative socities act . generally when flats are sold cooperative societies formed or you can form a condonium .
an application is made to registrar fro formation of cooperative societies . all flat owners have to sign the application .
it is advisable to have society regsitered . easier to recover outstanding dues in case of disputes . you can adopt summary procedure under section 101 of the act

Mr. shah, you have not mentioned the state in which the flat is situated. In Maharashtra we have the Maharashtra Ownership Flats Act under which it is obligatory for the builder to form and register a coop Soceity of the falt purchasers or a Conodominium of Apartment Owners in whose favor the sale deed will be executed. If the builder fails to comply with the above we have provisions for obtaining a deemed conveyance by approaching the Registrar of Coop Societies.Pl check if similar laws exist in your state and taske action accrodingly.
