We recently got allotment of our flat on redevelopment property which used to be chawl which is now society, but the flat we got was not a empty property. due to lack of our knowledge we did'nt know how to take allotment and made mistake that we signed on the copy of the allotment letter given to us by the builder in his office instead of giving receipt in the flat. now how can we remove people living in the flat. please help us out. if we take the matter to the court how long will it take and how much will it cost. Already had few advice on this subject but added few more things i remembered later, thanks.

We are tenant in a premises where we are running our office [commercial] since last 35 years. There is no written agreement between us and the landlord. however we had paid him onelakh 30 years back as pugree. Now the landlord is selling the property to one person who is going to develop it. The prospective buyer has approached us and is talking about two option- taken money and leave or a block. We are yet to discuss with him. Please let us know as per the rule if we opt for money what we will get and if we opt for the block i.e office whatarea we will get and whether we have to contribute any money for construction. The subject property is in maharashtra.

Would the Ld.Experts kindly give their opinion on the following?
My brother in law stays with his family at N.Delhi in his house built by his father. They were three brothers and one sister. Two of his elder brothers died intestate who had no children but their wives are surviving. One sister in law is in England and will never return to India. Other sister in law is staying in Kolkata. Sister lives in N.Delhi.
One Promoter wants to buy the house to construct flats and is torturing my brother in law for buying his share of the house. The promoter has gone to Kolkata and offered Rs.1 Crore to his living sister in law who agreed to sell her share of the house on condition that she will not travel to N.Delhi for ill health & the registration will be done at Kolkat Registration Office. The promoter has managed the sister also who has sold her share and also claiming the share of his 2nd brother who is dead & whose wife stays in England.
My question is.
1) Can the lady at Kolkata sell her share (i.e. her deceased husband’s share) and register the sale at Kolkata?
2) Is it not mandatory for her to first offer the share to my brother in law who is staying at the house at N.Delhi?
3) Can the sister claim share of the property of her deceased brother when the youngest brother (i.e. my brother in law) and his only son is alive and residing at the same house?
Thanks in advance.

My Grandfather has 3 sons and 3 daughters. He passed away even before I was born 30 years ago. He completely earned his property (NOT inherited) which he passed on to my grandmother who passed away 15 years ago. The property distribution has not happened.
My father is the second child and his elder brother has passed away.Currently there are 2 brothers (including my father) and 2 sisters alive.
Recently they have begun the process of distributing the property which consists of an independent house in Rajahmundry, Andhra Pradesh and a flat in Delhi. One of the sisters is now asking for 2 shares of the property of six (weird). I just dont like them and feel my father is getting cheated and exploited. As a grandson (the ONLY grandson in the family. rest are all girls)what rights if any do I have on the property? The grandfather passed away more than 40 years ago. Are his daughters even eligible for the property.
There is no will.
Really appreciate your help.

For a Non Agriculturist in maharastra, I am told that if he buys about 1 guntha of agricultural land in Madhya Pradesh, then by using that 7/12 extract, he can buy agricultural land in maharashtra.
Is it fool proof non challengable way to buy agri land in maharashtra ?

I am the GPA holder of my B-in-L and my Niece who live in the USA. This GPA was executed in the year 2006 and is not revoked. They have immovable property in Bangalore which they want to dispose off and have asked me to do so, on their behalf, on the basis of the GPA already existing.
Please let me know if the GPA issued in my favour can be used to sell the property by me on their behalf.
Thanks and Regards
