Land encroachment - no action by thalsildhar collector -

Dear Sirs,

My friend's father owns land under survey no 297/3 of 0.57 hec which is available in online patta and owner registration details. But FMB is wrong and showing area for 297/4 0.08 hec

Using this 297/4 owner has occupied and entertaining (cultivation) on 297/3 of 0.57 hec.

Due to which we applied for land measurement, complaints to thaslidhar, complaint to SP, collector, writ pettion etc. But no action taken till today.

Kindly suggest the proper steps to be taken next.

Sharing of common maintenance amongst the housing societies

Dear Sir,
Being a Secretary of the housing society, kindly advice on following matter :
We have 5 Nos. of 7-storied buildings (totalling 168 flats) and 1 No. of Tower having 32 floors (totalling 98 flats), all of them are existing in same campus and registered CHS Ltd. under the Maharashtra Co-op.Societies Act 1960. We have common campus which includes private street, garden, electric light poles, security guards at the main gate, etc. All the residents/ members of the above 5+1 buildings are using the common area. Hence, for the maintenance the said common area, I would like to know that what would be the best way/ formula to share/ contribute the expenses by each society building ? There is a ambiguity amongst the societies that whether we have calculate the common maintenance charges on the basis of area Sq.Ft.of each society building or on the basis of number of flats.? Builder/Developer, who has constructed the above (5-1) 6-buildings, has not issued Conveyance Deed to any of us. Please let me know your valuable advice.

Declaration and permanent injunction

declaration and permanent injunction decree.
1. Plaintiff decreed law full co-sharer and granted permanent injunction restraining defendant.
2. Decree date 22/01/2006 but plaintiff till date not execute the decree, scheduled land under possession in defendant (purchased land) 1995 to till date.
3. Decree holders are two members dies before 2008 one plaintiff are alive.
4. All revenue documents in name of defendant( my father).
5.please advice what can i do next process

Transfer of property with conditions

Sir, I have one house from which I earn rental income for survival. My wife separated from me and file many maintenance cases. She is greedy and wanted that property from me.She also wants attachment of the property in maintenance case.

Now I want to transfer the property to someone with following conditions:

1. He can't transfer the property in my lifetime without my written consent.
2. He will lease the property to me for lifetime at free of cost so that I can use it for my rental income.
3. After my death he will use the property as per his will.

Please suggest...

Regarding pagadi system

Dear Sir,

Currently m staying in mumbai. My building is 60 years old. We have stay there since my grand father. My house rent slip on the name of my father who died 5 years ago. I have some queries like :
1) If my building goes for re development so can i get ownership
2) What is the minimum are i can get as per law. (My current house is 240 sq.ft.) and if i have to purchase more area then what i have to do ?
3) If corporation puts Dangerous board on the building then what i can do ?
4) House rent slip on my fathers name. If cant transfer to my name, it will effect me in future ?

Transfer of property with conditions

Sir,
I have one house from which I have some rental income for my survival. My separated wife ( divorce case and 125 CRPC is pending) want that property. There may be attachment of the property by court in future.

I want to transfer the property to my dear one with following conditions:
1. He will not transfer the property without my writing permission.
2. I will get lease the property till lifetime at free of cost.I can use the property for earning by rent or by any way.
3. After my death, he can use the property as he wishes.

Please advise.

Probate of will & ownership change of grand father property

My Grandfather gave an unregistered will to my father and in that myself and my own brother signed as witness. My Father expired and also my grandfather expired. After looking to the all the documents that my father kept in the almirah after his demise, I got this will. And remember when me and my own brother, asked to sign we did not know what was that document at that time of signing. We only knew that my grandfather singed in front of us and we both signed in front of him and my father and my mother. Now that after going through the will, we came to know that it is a will and we are the two witness. Please advise if this will is valid, we as the witness are valid and can we probate the will and claim the property to our name.

Property dispute

I and my brother are two sons of our parents. My father expired in 207. The property that was there was in the name of our mother. My elder brother took our mom and got the property transferred in his name by the means of gift deed. My mother is illiterate. I was not present in court when she was taken for signing also only my elder brother his wife and his know were present while signing. My elder brother since has not considered my request for equal share of property.
Can my mother file case against him to cancel gift deed done in name of her elder son.
Is there any chance that my mother gets the ownership of property back.
