Hi,
I am planning to purchase a ready to move in flat from owner's share. The building has Occupancy certificate. I read in forums and also consulted a CA, about the applicability of ST and VAT. CA advised that no ST and VAT is applicable, only registration charges to be paid. Request the experts for their advise.
thanks in advance.

Hello,
My building is ground floor + 3 floors. Before 1987, there were 4 tenants and landlord. This property was constructed into a building ground floor + 3 floors. Ground floor was for all the tenants now with ownership and 1st floor for landlord and 2&3rd floor for new buyers.
Now in 2014, the building is going into redevelopment and builder presented actual area (usable) plan from existing structure to all members. My concern here is my flat agreement shows carpet area as 520 sq.ft and area measured by new builder shows 400 sq.ft. Same is with my neighbor. All the flats from 1st to 3rd have proper area (more or less same). So we 2 are left with less area than mentioned. Builder said they will not consider what is mentioned in agreement and will go with what is there now. He said it is your fault that you paid property taxes for so many years on 520 sqft area.
Please advise
1. What if all society member agrees for redevelopment and I am left with my neighbor (2 of us) - total members in society - 12 members
2. What should I do with this difference in the area?
3. I don't know where the old builders are, some say they are untraceable.
Please advise my plan of action.

We have certain properties in Kerala that are rented out in a lease basis.
1) What are the clauses in the contract to specified so that we will not face with any issues when we want to evict the lessee from the property? To be specific, the properties are 2600 sq.ft commercial shop space and 10 rooms of 2 floor rooms for daily rent.
2)I have been reading about laws the protect lessee from eviction by the landlord. But I have a general question. If someone lets out my property for a some (say n) number of years (am getting rent regularly). On what basis does the lessee have the rights to occupy the property without my will and win over eviction? And is there any law protecting the ownership of the property to myself? Is there any limit to the number of years that I can lease a property without worrying about loosing property ownership?

A builder is harassing his customers by threatening them to pay maintenance. He has threatened to charge interest for delay in payment of maintenance charges. He has as yet not provided the OC. He refuses to share maintenance expenses claiming that he is not duty bound to share the same, however he plans to give the same at the time of actual handover. He has collected maintenance charges at the time of handing over the keys of the unit. Now he says that that was only a soft possession. Some of the unit holders are staying in their units since 5 years. The residents have refused to pay maintenance as the maintenance is not up to the mark and secondly the charges for maintenance are too high when compared elsewhere. He has now increased the maintenance charges without the approval of the residents. No audited statements of expenses have been provided. What are the provisions as per MOFA?

Mr "X" (staying abroad) is a owner of a flat in our society. Mr. "B" is Power of Attorney Holder of "X" since 2002. As per PA Mr.B can sell the flat. The flat is on Rental since 2002. Now B wants to sell the flat. The PA Holder has submitted letter for NOC to sell. Society has not seen the owner since 2002.
Please advise us how Society should deal this transaction so that it in accordance with Act and Bye-laws of the society.

My father has been leasing out his property (in Kerala Thrissur Dist.) about 2600sq.ft from 2002 to a particular lessee where he is running a supermarket. There has been no renewal of contract since 2008 and there was a revision of rent once at 2008. The latest contract had the clause saying that the lessee will be ready to move out once the contract expires and lessor says so. Lessee has been giving the rent (the rent is way below the market rate and lessee is not ready to give a higher rent) regularly and he is still continuing. We would like to get him out of the possession. Does the law stay with us?
