Dispute with builder.

I have booked a flat and indenture recording an agreement was executed on 12/05/12. There are five blocks in the project. The construction of my block was started around November 2013. Now in my block the builder have completed half portion. The place where my flat stands the builder have completed foundation only. On approaching him for signature on Tripartite agreement the builder is asking for 50% payment of the cost of the flat.As per agreement I have paid 20% of the total amount at the time of execution of indenture recording an agreement. Now as per agreement I have to pay 10% of the balance amount on completion of foundation, but the builder is asking for 50% of the amount due. The bank has also sanctioned my loan and on talking to the bank the bank is not agree to do 50% payment. The builder is asking me to cancel the agreement which I do not want. He also refused to sign tripartite agreement with bank. He has not given anything in writing regarding the 50% payment.

Pl. advice what can I do in this case.

Sale agreement & cheque bounce

Sir, We have made sale agreement for one month which expires on 29th May, 2014. At that time amt was given by two cheques out of which one pdc cheque was bounced because of stop payment. The buyer is not answering any call of us. There is clause in agreement that "in case of cheque bounce it will be void." and " amt paid will be forfeited if not registered in one month." Can we forfeit full amt?

Shop dispute.

Sir,
My friend has purchased a house which has a shop in Ground floor,Shop at the time of Purchase of property was on rent & there was no dispute on this between the parties. And a new agreement was done between the shopkeeper & Owner. But the shopkeeper never paid rent of shop towards the owner.
Later the shopkeeper filed fake suit of mandatory injunction against the owner that she(my friends mother) is not the owner of said shop & the case is pending before the Court.
Now my query that the shopkeeper has filed an application for repair of the said shop.
Can court permit him to repair the said Shop.
Is there any Judgement which will not allow him to repair my shop as the shopkeeper not only being bad tenant has neither paid the rent and contrary filled a suit claim that the owner of the shop is some one else,

Partition dispute in an hindu undicided family

Dear Sir/Madam,

I would sincerely request you to explain the possible cases and a possible solution for the case I am describing below.

Our Hindu undivided family is from Karnataka and the family consists of,

(1) Grand Father (Dead)
(2) Grand Mother (Dead)
(3) Most elder brother
(4) Elder brother
(5) My father
(6) most younger brother
(7) two sisters (married 20-25 years back)

Now, the case goes like this, out of 100% property,

Grand father owned 20% (1)
1st elder bother 40% (3)
2nd elder brother 40% (4)

Both my father and the youngest brother has no family property registered in their name.

Earlier days, during 1980's and till now, most of the property purchases made for the family, are registered in the elder brothers name (40% + 40%).

Recently we had a family discussion about partition and everything went smooth and all agreed upon a meaning full partition where, total property,

grand fathers property 20% + 1st elder brothers property 40% + 2nd elder brothers property 40% is equally divided among all four brothers and the partitions deeds were about to happen in few months from now.

However now both the brothers are very reluctant to share the property with the other brothers 3rd (my father) and 4th (most younger).

Now what should we do? they are saying they will not share even a square foot of land with us.

Now should we take a legal stand? what are my fathers rights in this case?

I sincerely request you to provide your valuable advice at the earliest.
