In my building in one flat bathroom there had been seepage/leakage from its upper floor flat due to improper water proofing or gap of floor tiles of upper floor flat since the time of possession.
After possession the builder had done some plastering in upper floor flat and issue had stopped but now again cropped up.
The apartment is now under associations management and builder has left.
The leakage has again started and the upper flat owner says to lower flat that since the leakage is from the time of construction it is not his responsibility to repair and either the builder or association must repair it.
So the question is who is responsible for the repair?
Since once the builder had repaired it and has left now can builder be again asked to do the repair or the association or upper flat owner has to repair it?
Respected sirs
A sale agreement was executed and total amount mentioned in agreement was paid and meanwhile few documents were necessary to execute sale deed. So the seller demanded one lakh more which was agreed by both parties. And eventually 75000 was paid n balance 25000 later the same was entered in the sale agree:ment. Now it is more than a year the seller throws his hand in air saying he could fetch the necessary docs cos officials are asking big money. What should the buyer do now

Dear Ma'am/ Sir,
We are purchasing a running business from a private Ltd. company and the company is defalter in service tax, ROC & Income tax Act.
Therefore we have changed the nomenclature of transaction;
WE have taken a bill of Movable tangible assets on Letter Head of Company and signing a SALE DEED for purchasing Brand Name of the Business and restricting the company for not doing same kind of business with the same name in future.
Hence my query is:
1. Whether we can sign sale deed for purchasing Brand Name or Not?
2. Is Brand Name covered in the Definition of Property since there is any definition of Property in "Transfer of Property Act"?
3. How Much Stamp Duty will be levied for sale deed if Consideration paid for Brand is Rs. 125000?
4. And, Is registration of Deed with the registrar is compulsory?
Please Advice... :)

Query on pagdi system
Dear Sir,
My mother owns a house in Kurla,(Pagdi system) from last 27 years. We pay rent regularly. However the building is not in a livable condition and can collapse anytime during heavy monsoons.
We have asked the landlord to repair the building or redevelopment, but he denies doing so saying, there is a dispute among 8 brothers of landlord. Instead he has send us all a letter stating the building can collapse any time so request you all to vacate the premises and we will not be responsible if the building collapse.
I wanted to know what would be our (tenant's) stake when the building collapses. Will our rights in the property will remain or will be totally transferred to the landlord. What would be the further course of action.
It is a single storey building. Kindly help.
Regards,
Hari
