can relinquish deed be executed between the owner and co-owner who purchase the property by sale deed

Release deed

My uncle (Tauji) relinquished his and his minor siblings rights in two properties inherited on death of his father to my father and his siblings by way of release deed in 1971. I am the elder son of my father. Does I get rights on these two properties as is mentioned in the release deed.

Dda freehold conversion

I need to convert my leased property to freehold property but my current property is modified property with permission from all the owners staying in vertical extended portion.Will it cause a problem while converting to freehold and if it is a problem is there any way of we can pay extra for the modified part and get it sorted.

Precaution to take for pending case before leaving india

My Revision Application before Divisional Joint Registrar, Co-op Societies, Mumbai is pending and I have to leave India in Mid of Aug. 2022, in this case what precaution I should take that if I am not available still judgement is given but it is not dismissed due to my absence. I am leaving India because I got Immigration Visa of USA and my visa validity is up to 2.9.2022 so before this date I have to leave India. Thanks

Partition suit

Hi , the lands we inherited came from our grand grandfather. Now in our father's name. Our father has two daughters and a son . But my brother is arguing that I want all the property to him . I decided to file a partition suit in court for my share. Now if I file a suit will the three of us get an equal share? Should our sister also file a separate partition suit for her share? Will she get her share if she does not file a partition suit ? Please guide . Thanks in advance

Change of private path

I am from Virudhunagar Tamilnadu. There is an ancestral property from my mother's side in Virudhunagar Town limit. After my grand mother, the property was divided into 3 portions. There is a L shaped private path that is used to connect to the main street.

My mother has given her portion as Gift deed to me.
Now, we want to change the private path to a straight path. My aunts are ready to change the path and register it.

The land of the L shaped path would be given to one of my aunt and she will give land for the straight path.

Is it possible to change private path in Tamilnadu?

Notice under sarfaesi act

Hello respected experts,
I purchased a flat in the year 2018 from a builder company having proper right title interest over the same. In the year 2020, we got to know that the company had taken loan from Reliance for the project and due to non payment, reliance has filed insolvency proceedings against the company which is still pending. Recently , the ICICI BANK person has affixed a notice under section 13(2) of Sarfaesi Act in front of our flat from which we got to know that d company had executed a regd AGREEMENT FOR SALE in favour of d wife of the managing director of the company in the year 2016 and on the basis of that agreement she obtained loan of rs.50 lacs from the bank. In that loan her husband the MD of the company became Guarantor in his personal capacity. Thereafter no sale documents was executed in her favour. Now since last few months she did not pay the emi and accordingly the bank has issued notice. It is to be noted here that neither the said wife of the MD nor the company nor the Bank filed any claim before the NCLT in the insolvency proceedings regarding my flat. Technically, the loan applicant is not the owner as no deed of sale was executed in her favour in respect of the flat and her husband, (the MD of the company) became Guarantor in his personal capacity and he has no right over the flat personally. So my query is is there anything due to which I should be afraid of? Now what should I do? I am thinking of giving reply to the notice stating all facts. But if the bank does not reply, what is my remedy? Can I directly go to the DRT and pray for stay against the notice or what other remedies are available to me kindly suggest. I shall be indebted to you for the advice.

Laying water metrrs in apartments

Sir,
In our apartment where an unregistered society is running affairs of the apartment has taken a decision to install water meters without approval of the members concerned.
Now that association has been dissolved and a AD HOC committee was formed by the so called association which has not been registered.
The outgoing President who is not even in the AD HOC committee has started laying pipe line’s and installing water meters from his own pocket and has been threatening to stop water to those who do not pay him for the installation. Many are against the meters, but this person with support from a few members are making the members of the apartment miserable.
Please advise.

Unregistered apartment society

Sir,
I have a apartment in Hyderabad, i have let it out, there is a AD HOC committee running the affairs of the apartment, the AD HOC committee consist of two persons, they were nominated by unregistered apartment association.
These two persons have been taking unilateral decisions without consulting the members of the apartment. When they are asked for a meeting they never respond.
Please advise.

Jurisdiction of register in west bengal

Sir/ Madam I purchased a flat in 24 Pargana District & a land in Birbhum district from the same seller and the registration was done in DSR Birbhum on 2013. Now the lawyear of a private bank is denying to mortgage the said flat because as per his view the DSR( District Sub Registrar) has no right to register a land/building at Kolkata. As per consultation with the DSR it reveals that DSR can reister the land outside his area if another land is registered in his area/jurisdiction. But the legal team of the bank is demanding section of rules or act. Pl help me regarding this matter.
