I am pitted against some crooked members of our society who are hostile to me due to objection raised by me against the builder who did not get OC and did not convey the land in favour of society. The building was completed in 1990 and society was registered in 2003. I am the original buyer of flat and have been paying my society dues promptly all these years but the society is refusing to accept me as a member and issue the share certificate on the pretext that although I have paid the adjudicated stamp duty but the agreement is not registered. The builder did not cooperate for registration due to my complaint under CPA about poor construction work and not providing all the amenities that were in the agreement. Now His where about are not known. I want to register the sale deed but the foul order of state govt. asking for payment of stamp duty at current rate is challenged by a PIL and it is un fair to ask for stamp duty at current rate. Pl advice how to deal with the situation.
We are 2 brothers and 2 sisters. I am one of the daughters. We have one house and 2 acres of land. All the property is in mothers name and Nominee is My Father. My mother expired. Can my transfer the property in his name without no objection certificate from daughters. Can he write a will saying that 2 of his sons are legal heirs of the property.
Actually my father promised daughters that, he will give 1 acres to each of us and house will be given to sons. But now he changed his mind and want to give all to his 2 sons.
Do Daughters have any right in such case. Can my father write will saying that his sons are legal. As a Nominee, can he have all legal rights on the property.
Do my father need NOC from his daughters are not required.
Can you please help me out

In a registered housing society, if some flats are illegally constructed, can managing committee refuse share certificate to such flat owners? These members are paying maintenance charges as well to society? What is the rule?
Hello Learned professionals...
Regarding My Father's share of property which he received by way registered partition deed of 1958. My father received his share from my grandfathers share of property. He jointly hold the property with his unmarried brother (my uncle-C) who died in 1969. They have other 2 brothers also (my uncle-A & my uncle-B). My father, uncle-A & uncle-B are all died since. My father, uncle-A & uncle-B are married have family & children.
Now a few months back, we approached both my uncle-A & my uncle-B family to clear the title of the deed which is jointly held by my father and deceased unmarried brother. Though we offered a decent amount, SOME of the family members of uncles want to sell the property. We don't want to sell the ancestral house as my mom and brothers are emotionally attached to it. we are staying in the house for the last 50 years or so... They had not approached us so far for any share, we only offered decent settlement.
Any way while we expect to settle the issue amicably, we foresee a delay of one or two years in settling the issue with discussions.
We plan to have annual maintenance or renovation of the house before next monsoon. If we start do repairs, can anyone stop us by a stay order or injunction.
Please guide us
Gpa from son to father and daughter selling ancestral property
I am purchasing a plot from a newly developed layout. The layout is developed over land belonging to two person. They are brother and sister. This is their ancestral property and the partition papers are registered.
Brother as two children and children have given GPA to their father over 200Rs stamp paper and its notarized.
And sister have children and they are not coming for the registration.
Questions:
1) In the first case, if the GPA done from sons to father with 200Rs stamp paper and notarized is enough for registration or the GPA needs to be registered ? (Developer says, for near blood relation this should be enough.)
2) Do the sister's children need to give NOC for the sale of sister property. ? (Developer says property came from partition to daughters is not ancestral property, hence children NOC is not required.)
Thanks in advance.
