Urgent - get stay order on society who doesn't follow any byelaws or gr dated 3-01-2009

Greetings,
We stay in small C.H.S. having 8 members Building was constructed in late 1990s. Since last 4 year, I had tried to get Conveyance of Society and we also appointed professional to get it. Initially he told us that it will be matter of 3 months.

However existing builder did not gave response and after 1 1/2 year, we had to get our money back from professional as he failed to get our Conveyance.

Now old builder have sold redevelopment/Conveyance and other rights to another builder. Who wants us to sign MOU for redevelopment with him, then only he will allow us to get Conveyance.

Chairman of society is showing extra interest to sign MOU with builder without following any following procedures Bye laws or GR on redevelopment of 03-01-2009.

Though I being secretary tried to explain terms and legal proceedings and other legal/Technical terms, in SGM 6 members out of 8 members have agreed to for redevelopment and sign MOU.

Que.1> How can we (opposing 2 members - including secretary) get court/registrar/legal assistance like stay or so.

Que.> What is Court Fees and other Legal Charges to get legal assistant in Mumbai.

Thanks in advance.

Owner's association asking for original sale deeds to deposit with them.

In Bangalore owners of apartments of a building have formed an association under societies act,(not as a co-operative housing society wherein the ownership is passed on by the Builder by conveyance)for managing the affairs of the premises/Building.Now this association is insisting for deposit of all original sale deeds with them from individual owners. Can the association insist for it,whether this is allowed in law, whether there is any provision in the statute?or whether they can be custodians of original sale/title deeds which the individual owners of apartments are holding?.I have been a member of co-operative housing society in mumbai for 45 years,I have never come across our or any co-operative housing society asking the members to deposit original sale deeds with them?PL.advise.

Builder not completed the house in time

Hello,
I bought a flat in 2010 and registered in 2010. It was under construction. The builder till date has not completed the project in all respects. That is water, electricity , lift, power back up is pending. However to his credit, he has allowed few buyers and land owners to live and is paying for the electricity bill, now that is also cut. What can the buyers and land owners do?
In the sale agreement, he had mentioned that he will finish the project in early 2011, however the same is not mentioned in sale deed. This is true for all buyers. Please suggest what should be done

Pil status ?

Pl. up date on the out come of the PIL that was filed in High Court challenging the foul order of a corrupt politician who wanted stamp duty to be paid again at current rate for registration of agreements even if it is adjudicated and paid earlier? His party lost severely in recent assembly election and he had offered his urine for the farmers of Vidhhrbha

Fungible fsi,mumbai.

Fungible FSI,Mumbai.Commercial Complexes.

We are the members of B.H.C.Municipal market licencees's association not registered still. In 2004 Municipal Corporation had invited private players to develop the municipal markets for whatever reason,as laymen we do not know. We had given irrevocable consent letters to RNA Group's GA Builders to redevelop the market in 2004.he had promised us 20% increase in existing area of ours and an alternate place during the construction period or monetary compensation during the construction period (i.e.rent +Corpus fund),now due to market conditions or the elder family member passing away they feel the oral commitment made by the elder is not viable or feasible now and say we can give you only a certain sum not fixed as corpus or whatever you may name it and that too in monthly instalments only.
area of our gala is 154 sft each.
My contention is since as per 6,Jan 2012 Maharashtra Government notification w.r.t.fungible fsi,as such we are eligible for free 20% increase in fsi legally as exisiting tenants and he has not shown us any favour and we have to get additional 20% increase in fsi as promised by the redeveloper in our proposal then in 2004,as he has got his plans passed in 2014,when fungible fsi is applicable. He says he has lost lot of fsi which was available to him to free that time i.e.before 2012 and is not possible to pass on this fungible fsi to us in addition.
But the IOD Condition given to him by BMC in march 2014 clearly mentions he has to obtain a General Body resolution of members of the association for utilization of fungible fsi to the existing tenants, please advise!

Division based on enjoyment plan

Dear Experts,

My father got his share of ancestral property along with his brothers. He has patta passbook that specifies his share of survey numbers in Telangana state. However, the land is being repartitioned again. The land has been surveyed as per enjoyment plan. There are no teepans, no field measurement books, no stones etc. We got it surveyed a couple of times, and we got different extents. We do not know where the starting point is and the boundaries are by estimation only (the ending points of neighbors cultivated lands). In view of this, do we settle this with mutual discussion (and go as per enjoyment plan) or ask for an authorized person to mark the boundaries, so that we will have no hassles in the future.
Thanks in advance for any information.
