Builder is not ready to refund booking money.

sir on 20/03/2009 i booked a flat with Nanak Properties Pvt. Ltd. Andheri, Mumbai at his ongoing project at kharghar, navi Mumbabai. After a week i realized that i am not getting a required amount of loan. So I asked the builder to refund the booking amount i.e. Rs. 51,000.00 which was given to him through cheque and a receipt for the same was received. That time he promised verbally that he will refund my money but now he is refusing to return my booking amount.

There is no any agreement or MOU is signed between us. Kindly tell me what is the law say on this, if I can get the amount how to go about it? Ramesh Singh

Guardianship of 14years old girl child

Greetings to all members and Indepenceday wishes to all.

My Brother was expired in 2004 leaving behind his wife, two grils aged about 9 years and 6 years then and dependent mother.
The elder child is with my sister since 6 months of her age. And she is taking care of everything of that child. The child is willing to remain with my sister and doesnt want to go to her mother at all.
there was partition case pending in the court filled by my mother for her share in my brother's property as she is dependent and my sister as guardian of the elder child of the deceased. The lower court dismissed the petition filed by my brother's wife asking the guarding ship of her elder child(now 14 years old) and her property who is growing up with my sister. Earlier about 4 years back the child herself told to the judge she wants to stay with her aunt and not willing to go with her mother. The same is marked by the judge. As the petition is dismissed by the lowercourt judge my brother'w wife is now planning to move to highcourt.

Now i would like to 1)whether the child opinion will be taken into consideration of the high court of not.
2) Is there any judgements regarding the case above.

138 N I Act.

Sir,
A case was pending aginst my client u/s 138 NI Act.before the court amounting 16000/- but my client have two cheques (SELF) issued by complainent to him but he didn't initiated legal procedings according to cheque in time and he is also unable to go for civil suit because of lack of courtfees and other fund. will he present the same in already pending cpmplainent for the puopose of defance?? is there any law?

Oridinance

Sir
In the year 1997 a letter was issued to appointment of Appropriate Authority under the PNDT Act but no notification was issued. However on 4.3.2009 notification was issued in which CMO was appointed as Appropriate Authority. Now Haryana Govt takes oridinance vide which powers were given to CMO as appropriate Athority .Whether this oridancnce has restropective effect? Wheter oridinance is legal without setting a side the Notification dated 4.3.2009 in Criminal Maater?

Sir,
please tell me the provision under which court can release a property, which was recovered by police during the search of arrested person but is not case property, as accused private money or credit card or driving license. Please cite the ruling if any.
I am facing the problem because court has ignored the plea of my client to release his driving license and says that it has no concern with the property which is not a case property.

wife claimed maintaninace from husband for herself and her minor child, husband is not working , and not earning, wife is working and earining, can husband conterclaim for maintanance from her wife? when wifes application is pending for written statement.

sale of ancentral property

hi
can a grandson, who is living sepratly with his mother, from her fathers family, can claim share from the sale proceeds of his grandfathers coparcnary poperty?
the grandfather sold the coparcnery property and now the grandson wants his share in it, is there any law in haryana for doing so, if the grandfather makes will for the sale prodeeds of coparcenary property, then can the grandson claim so?
kindly give law in which the grandfather avoids so, because grandfather dont want to give share in sale proceeds to grandson

custody of boy kid

hello,
can a father claim cutody of his son from his (fathers) wife who is living sepratly in her mothers home and the boy is 11 years old, there is total 3 sons and two sons are living with father, and now father wants one son too who is living with mother, kindly tell the relevent law for demanding custody

I am a Chief Orth Surgeon in MPSEB Hospital. I am seniormost in Med. Wing of the Board. Recently on 31.7.2009, my Ex CMO got retired after ataining age of superannuation but on 1.8.2009 he has been given Job Contract and is attached to the office of the CMO with full adm. powers of the CMO. Thus I have been snatched my legal right of promotion.

Is it leagl to give full adm. powers to a person after retirement who has attained age of superannuation?

Is there Supreme Court Judgments related to it.
