Bank has issued bank statement with my consent

(Querist) 22 November 2011 This query is : Resolved
Recently, the bank has issued my salary account statement to my wife without my consent. She got the statement by her father's clout. My salary account is with noida's bank but she withdraw it from meerut. She used that statement against me in ongoing proceedings of crpc 125 (Maintenance Case).
After my investigation it could be concluded that bank has no such request to withdraw the statement.
Now, i have two concerns 1> what can be done against bank 2> what can be done against my wife because she has done illegality somewhere.

What proof do you have to show that it was the bank which divulged the information?

1. You can lodge complaint with the RBI for sharing your private data with your wife without your consent.
2.Nothing.

1.Bank is probhited to provide information to third party. Since bank issued bank statement, lodge complaint with the RBI.
2.Nothing, same as advised by Mr.Barman.

You can claim compensation from the bank for disclosing the personal details to a third party.

I don't agree with experts.

No action would lie against the bank, as no track is kept who took the statement. Moreover, your wife can always say, she got it through some of your friend or you yourself gave it to her.

Shonee ji,

There is always a provision in the banking software that whichever employee of the bank accesses data on the database of the bank, his identity with timestamp is recorded in the concerned account. So, it will not be difficult to identify the employee of the bank, who would have accessed the account of the querist and on what date and time, for the purpose of taking a printout of the salary account.

Dear Praveen,

You can hold the bank as well the employee of the Meerut branch responsible for unauthorised access to your personal account for taking and issuing a print out to your wife, as the employee can be identified, provided that your bank branch helps you suitably. For that you can make a compaint to the vigilance wing of the bank to investigate the matter. I feel only after that it would be appropriate for you to take up the matter against the bank and its employee in a court of law after that offence is establishd through the vigilance.

But on the other hand, you may probably not be able to establish whether your wife, her father, but not you, would have taken the printed copy of your account. However, as you reveaved about your account standing at NOIDA, probably you may also be residing only at NOIDA, that aspect may help you to raise finger on your wife or your father-in-law for illegal activity of taking statement of your account illegally.

In this case you can fix only the identification of the employee of the Bank who has taken the extracts of your a/c by taking a screen shot as software access is given to employees by a password allotted
to them ;but fixing that itself can not lead to prove that he directly gave it to your wife or to your father in law.He may plead he gave it to you, unless for such extract there is practice of taking application from the a/c holder.

As regards to your wife you can not take any action against her.

Moreover ,was it not within right of court
to bring this fact or your a/c sheet on courts record by summoning it on the initiation of your wife from the bank??

Why are you agitated over a matter you can not conceal???

The bank is liable for compensation.

After the investigation into the matter it has been revealed that "Puneet kathuria" who is manager of HDFC life asked for my statement. Bank employee had issued statement in good faith to him. On email- This all have been accepted by branch manager of meerut, by copying vice president and all in copy

This is offline that puneet kathuria had given this statement to wife's brother.
Can i do the followings:
1> Can i ask for compensation from bank and how much?
2> Can i take action against puneet kathuria as he misrepresented himself before bank? or against bank such as breach of trust etc.
Guest (Expert) 05 December 2011
You may, if you like, sue the bank for breach of trust/faith and ask for adequate compensation, as you may think about estimated monetary loss caused or likely to be caused and also the Manager for criminal conspiracy against you in connivance with your wife's brother.
