my father has bank a/c and he has been expired can we use his ATM card to remove money?

No. You shall not do it. If you are caught you will,be hauled up for the offences of cheating,impersonation,misappropriation,theft and other related ofences including one for cyber crime.

You can use it if you know the code, but to avoid the future litigation from the other members it is better to apply for the probate and succession certificate from the court.

No, you can use it. The card is given exclusively to the account facilitating easy withdrawal of money any time based on the implicit agreement between the Bank and the customer. Once the person is dead, no other person can operate the ATM Card. If anybody attempts as Mr.Submanian said, he will be hauled up for the offences. The legal heirs should surrender the card to the Bank and fulfill the formalities of the Bank for payment of the amount to the legal heirs.

Never do such practice because if you are the only person who knows the password then you can be indulge in great difficulty in future, kindly get succession certificate from court and withdraw the whole sum, and inform the death of account holder to the bank manager he assist you what to do.

Never resort to such practice and get yourself in trouble. Approach the bank and first get the account blocked as this idea can also emanate from the minds of any finders of ATM card even in your family circle. Get the account settled on submission of necessary documents which is a very simple procedure.
