(Querist) 26 June 2020 This query is : Resolved
I am a resident if Andhra Pradesh. My grand father bought some assigned land in 1987..My father has got those land as property from my grandfather in 1997.My father father has kept those land as vacant from last 3 or 4 years .Now the MRO and VRO came and claiming this land belongs to government. The local leaders are behind this action.
Without any prior notice thy came with the JCB and removed all the plants and trees in that area.We have the agricualtural land passbook .We took few loans on that land ..We are even paying the tax for that land more than 20 years.
Can someone guide us what kind of action needs to be taken in these scenario. What are the GO numbers do i need to refer to go against the MRO and VRO.
I am thinking to go for stay order but what papers do i need to have and take care ..

I heard from some people where if we pay tax for the assigned land for more than 18 years then it will be the puchaser.but here we have paid for more than 30 years .

Please someone guide what action do i need to take .

Since the land was allotted to your grandfather for specific purpose and specified period, thereafter the land can be taken back by government.

It is a pecular case wherein local laws apply, it is better to consult a local prudent lawyer for appreciation of facts and documents, analyses with reference to provisions of Act applicable in the instant case and guide you properly.

There are various categories of the assigned land. Such land can be given permanently and also for a specific time or purpose. You need to obtain revenue record and allotment letter with site plan and also photographs/video of the present situation wherein the authorities without serving any notice have forcibly occupied the said land and immediately move to the civil court on the basis of the said record with the help of local lawyer dealing in land law cases.

Local law applicable.

Discuss with local lawyer and try for a stay. Some senior and experienced lawyer may ensure better result.

Your lawyer would guide you, what documents are required and how to proceed.

What ever be the situation, the action is not lawful unless you were given opportunity to show cause.

How can be anticipated that the authorities have taken right action without having any material with us? Do authorities not take wrong actions?

I am sorry. My earlier posting may kindly be read as "What ever be the situation, the action is not lawful unless you were given opportunity to show cause." instead of "What ever be the situation, the action is lawful unless you were given opportunity to show cause."

The error is regretted. I have since modified the posting.

Yes, it is the rule than the exception in our country that authorities take wrong, even willfully. Not only that it is most often the case that they are not willing to assume the responsibility of making amends even in cases of blatant illegalities are so obvious. The prevailing mantra is "let them go to Court".

Courts have proved to be of great relief for victims when any unilateral / unjustified / illegal /action is taken by administration / officers / police.
