Arbitration award / mou copy

(Querist) 03 December 2014 This query is : Resolved
What is the procedure for getting a copy of the Arbitration Award & Memorandum of Settlement reached between a public listed company and a private bank in India. A dispute was referred to an Arbitrator who passed an award in a Foreign Currency Derivatives dispute which arose on account of Sub-prime crisis during 2007-2008 in India and elsewhere across the globe.
ajay sethi (Expert) 03 December 2014
only parties to the disputes would receive copy of the award from arbitrator
M S Subramanain (Querist) 03 December 2014
Thanks Mr. Ajay Sethi for the prompt reply. Before reference of the dispute to the Arbitrator by the High Court, the Company had filed case against the Bank and two others. In the Arbitration proceedings the two others are not taken as parties. But in the WP filed in the HC, Chennai which was disposed for reference to Arbitrator these two were parties (defendant). As an aggrieved party of the dispute whether any of the two can have the right to get a copy of the Arbitration Award / MoU pl.

why you have mentioned mou copy with arbitration award. it seems that some fact are missing.
Guest (Expert) 04 December 2014
MOU has no independent standing, if award has been granted in the arbitration case. MOU in that case has only reference value.

You can have the copies of the Arbitration award and the MOU only from the party, who appointed the arbitrator.

Consult local lawyer and show him all the documents.
