Dear and respected experts,
As per your advice i have hired an advocate.I have one more doubt Is it must that my wife should come to the court on the first hearing .Is there possibilty for not coming ?If I demand for counseling can she neglect for coming to counseling?

M.Sheik Mohammed Ali (Expert) 09 January 2012
whats your nature of case ? the appearing of the wife before the court depend upon the fact in issues.

I assume that you are Mr.Jayapal.

If yes, you are sufficiently advised.

Further advise will help you only in accumumation of confusions in your mind.

You have taken a right step by appointing a lawyer.

Your wife may oppose. But it is up to the court to decide not your wife or her lawyer.

Trust your lawyer and act as per his advise.

I think you case is matrimonial case. On the date of first hearing it is not necessary to attend your wife to the court.
Devajyoti Barman (Expert) 09 January 2012
In civil cases except for participating reconciliation and for givng evidence one's personal presence is not required nor any adeverse inference could be drawn fro her absence.
