Alimony issue.

Respected sir/madam,
i would like to apply for divorce because of non adjustable situation between us.we have two childrens aged between 7 and 4 years old.I wish and able to look after my childrens welbeing but don't want to give a penny to my wife.
Now my query is, though i do estate agency job i don't file IT and there is no proof to show income since it is fluctuating in nature.My wife blackmails me of going for divorce and if at all she do, how much it effect me while case comes for alimony?.my father have shops and flats in mumbai, and we are of 8 sibblng .if i go for divorce does my wife have the right in my fathers properties?..we advice me.

No your wife has no right on the property belonging to your father.
However you have to provide her maintenance.

Whether you want to give or not law will take its own course. Simply because you have filed IT returns you can escape paying alimony. All depends how your will present case. You have two children. Think, is it necessary to deprive them of her mother? If they are deprived of it, you can not buy their love even if you give crores of rupees to your children. Hence, do not take hasty decisions. You have not revealed the reasons for your conclusion.

Court generally does not give the custody of minor children to husband till it is fully satisfied on merits. If you don't pay the maintenance to them their progress would be effected adversely.
Court will decide all factors on merits.

Maintenance you have to pay. More or less. Can't avoid payment of maintenance.
