Legal notice for medical negligence

Hello Sir,
I would like to know in the case of medical negligence matter,who should be the Petitioner,i.e.Patient (paralysed) himself or any near relatives like elder brother would be fine. As in the instant case the patient is paralysed from below chest and is unable to walk or sit. So in that case the legal notice should be sent to the Hospital concern and the Doctors in Patients name or his elder brother name.

The authorized representative /lawyer of the person can issue the notice.
The DCDRF can be an option....

For filing case in consumer no need for sending any legal notice .

Consumer case can be filed by the patient, or his legal representative.

it should be sent in patient name .patient can also issue POA to his brother fro filing complaint before consumer forum

Dear Querist

It should be through lawyer with the detail of the patient who is suffered from the medical negligence.

if the hospital/doctor is not ready to make the payment within the notice period then the patient or his POA holder may file the case before consumer court against the hospital/doctor.
