My husband remarried during pendency of divorce.

Can I make complaint at Police Station ?
Is it necessary to make court complain for the offer ?

No. When a divorce case is pending either party cannot marry the other and it will become bigamy. File the affidavit to that effect in the court. What is the opinion of your counsel?

My counsel advised to lodge Bigamy complain.

Yes,you may file complaint for the offence of bigamy. Consult to local prudent lawyer.

The offence of bigamy being, no-cognizable, you need to approach the Court at the first instance.

If you and your spouse are Hindu, you should move a complaint through your lawyer before area Magistrate under section 200 Cr PC for taking cognizance, summon, try and punish accused husband under section 494 IPC.

Police shall not accept your complaint being non-cognizable offence of bigamy committed by remarrying during subsistence of marriage.
