my aunt (younger sister to my mother) unmarried, died at the aged 90+ had executed a registered will in favour of my real sister regarding aunt's lease hold property. Now the respective housing board authority asking to deposit requisite transfer fee ( un-earned increase) since it is transfer outside blood relation whereas "within blood relation/ inheritance legal heirs-non testamentary" it is exempted.
under the circumstances, what's the advice, please

Dear querist, transfer fees is separate. Hence your sister has to pay the transfer fees.

Read housing board's transfer rules. If they are demanding transfer fees ignoring rules in that case you can take legal action against the housing board.

as per authority rules, transfer fee is waived off in case transfer is in blood relation but since my unmarried aunt's has no surviving blood relative i. e brother, sisters, parents and authorities are not treating her sister's daughter as blood relation so they are demanding transfer charges.
is not it amounts to disparity?

As per rules quoted by you sister's son or daughter is not regarded as blood relation. Hence transfer fee will have to be paid.
