Will

(Querist) 18 May 2015 This query is : Resolved 
Sir, my father has a unregistered will. He is alive. He has only FDs and bank balance in his Will. No property. I am major recepient of FDs and bank balance in the will. As per will,the other 2 brothers receive little and nil monies respectively . I am second holder in all FDs, and some funds are parked in my account by my dad.
My Question:
Can the other brothers obstruct me from taking the funds (after expiry of my dad).

The will cannot be questioned after the death of your father, but to scrupulously abide.

Since the will is not registered, it is vulnerable for disputes. After the death of your father, the movable properties, if any existing, would be distributed in accordance with the terms of the will. Your brothers cannot take away your share.

Your brother can not claim as against the will, if it is not changed.

At the time of execution/probating of the "unregistered will" your brothers can claim a share. However, it depends upon the attesting witnesses whether their (your brother's) claim shall be settled.

Even the unregistered will is held valid in the eyes of law.The beneficiary can very well claim the benefits bequeathed in the will in his favor accordingly once the will is coming to force. Get the will probated in case of any dispute.

Take signatures of your two brothers as witnesses of the Will.
