i have query about hostile of witness in will. my mother has drafted her will in 2005 with the signature of 2 witnesses. i have a doubt if the witnesses becomes hostile the value of will will zero. so advice me.

the situation may arise in future.may the witnesses become die or locate anywhere or some wroing may happen.
the whole thing is i have only will but none witness then what will happen.

it is a hypothetical situation . cross the bridge when you come to it .
if you so scared of will then have gift deed executed

contact a local lawyer . where are you in UP? many lawyers on site from UP .
mr prbahkar singh is from varanasi . contact him have gift deed wherein entire property is bequeathed to you . have document stamped and registered

gift deed execution attracts stamp duty @7% of property market value and registration charges around rs.10000
If you are muslim, no stamp duty attract nor registration neccessary.

If you profess Hinduism a registered GIFT DEED shall be required which shall attract as much duty as a sale deed does,but it shall make you owner then and there.Your mother shall done you with possession of property without receiving a single penny from you out of her natural love and affection and you shall accept the same and transaction shall get completed.
In case you profess Islam the same thing is allowed by ORAL GIFT,NO WRITING OR DUTY REQUIRED OR REGISTRATION REQUIRED.

how much cost me to create a gift deed. my property have market value about 30 lakhs. give me clear advice having some particulars in mind.
1. we have 2 brothers & 3 sisters famly
2. my mother in 2003 bifurcated my elder brother from family duly registered & notified it in newspapers.
3. she also create a will in my favour with 2 witnesses of otherside of my family which are much close to my mother.
4. but now i am scared about will. because i dont know much to witnesses.
5. my point is if witnesses does not appear to testify will at the time called by probate court, will it be stand or not
6. if my other family members challenge the will, and want to cancel the will, what are the remedial measures.

while your mother is alive why are you eyeing her property? your mother may need funds for her treatment , for her expenses .
she has to take care of her interests too . for some apprehension in your mind about your other relatives challenging the will why should your mother suffer . ?
in short after great deal of deliberations your mother has decided to bequeath you property by her her will .
for will no stamp duty , registartion charges are payable . it is cost effective .
get the will drafted by some lawyer and he will safegaurd your interests

mr. ajay sethi as you dont know the full thing you cant say that i am eyeing my mother's property.
1. my parents are happy with me and live with me after all other members not interested to look after him.
2. my mother want to give his property to only me.
3. this is her desire not mine.
4. i am taling you because she wants to handle over property to me.
5. not much interested to property but much interested in family.
