Whether possession if sufficient

(Querist) 12 April 2013 This query is : Resolved 
A allowed B to leave in a house without any consideration and B was leaving for last 33 years. Now A and B expired. Now wife of B is leaving in that property and is in sole possession. A left the property 33 years ago and had his separate house. Now the wife of A is demanding vacant possession and threatening to remove the wife of B. What is the legal remedy available to B's wife ?

B's wife is a licensee in that house. It is not a case of adverse possession since A has allowed to live in that house and B was living in that house knowing well that A is the owner of the house. B has to vacate the premises and handover vacant possession to A. However, B is not liable to pay any rent or consideration amount as it was a leave and licence given to B.

Does A have any documentary proof of his title.?

Is B also was a local native?

In whose name utilities are billed,i mean electricity,water,municipal taxes,in whose name house is recorded in municipal record,
any ration card issued?????

Or it is a house in village???

It can be a case of any thing as all is like "nani ki kahani nothing written".

I mean detail up as much as you can.after all she is lady.he can not through her out.
Police is there.

Create circumstances that A goes to court not B's wife.

Being experts offering free of cost services and devoting much time for social service by doing so, we need to increase honesty in the society instead of telling ways to increase dishonesty.

In the given case, the wife of B should approach the wife of A to register the sale-deed in her name by charging a nominal amount thereto as she is in adverse possession since a long time though this plea is not available to her as the possession is permissive.

I do hope that the offer shall be duly accepted and the matter shall get resolved beneficial for both parties otherwise let wait legal action from A's wife.

cannot disposes without adopting due process of Law.

So B can further Live there almost lifetime.

for 33years B and his wife stayed in the said premises without paying a penny . if B wife refuses to vacate A wife will have to take leagl proceedings to evict her . amicable settlement is best option .
