Water leak from the above flat but the owner is not ready to repair

(Querist) 13 August 2013 This query is : Resolved 
I'm living in Kolkata, west Bengal.I have a second floor flat with two flats above me. It's a new building built almost 4 years back.I have lost count of the amount of water leaks I’ve had from the flat directly above into my property. The landlord above is so difficult and arrogant. He is neither repairing this by himself nor allowing us to repair the leaks by our own cost.The situation getting worse day by day. Please suggest what can be done.

issue legal notice to owner of said flat . move court to direct the owner to carry out repairs

In such situation legal recourse seem to be the avenue left when amicable settlement not possible.
