Hi, this happened at Pune at my aunt's place, there is a mango tree in her garden and her servant comes regularly and climbs the tree and pluck mangoes but the other day while doing this, he fell down and was unconscious. Immediately he was taken to hospital, he was declared dead, ECG reading was negligible no hospital agreed to admit him and finally the third hospital where he was taken admitted him, could you please tell me what legal implications would arrive in this situation?

No implication if the family of the servant do not file police complaint.

If they do alleging forcible climbing, then u r Aunt will hv to go through the process of criminal trial.

But there is nothing which may stick to her.

your aunt is liable for compensation to the relative of the deceased servant. No criminal case is a possibility.

The relative's of deceased may lodge a complaint against the owner of the building but the owner can challenge it during trial, however she may not be liable if she has not given any instructions to pluck the mangoes from tree located in her house.
