Voting in co-operative society

(Querist) 26 June 2013 This query is : Resolved
Dear Sir

I have to queries

1) Can a member who is the owner of three commercial units in one Cooperative Society under different company names(Proprietorship and partnership) cast three votes in a Society meeting?

2) Can such a member have other communication options for casting his votes? E.g. sms, mail, telephone call etc. Since Video conference is permitted in board meetings.

Many thanks

The bye-laws of the society are to be seen whether such steps are allowed or not.

A person as individual may have separate entity as proprietor of a firm, partner of a firm or director of a company. This is due to his position in the firm.

For the way of casting of vote bye laws and customs are to be referred. The version of the presiding officer may count if rules permit.

1)ALL OF FIRST IT SHOULD BE UNDERSTOOD THAT RIGHT TO VOTE IS CONFERRED TO A NATURAL PERSON AND NOT TO EVERY JUDICIAL ENTITY.

2)THERE CAN NOT BE OR SAY MUST NOT BE MULTIPLE RIGHT OF VOTING TO A SINGLE PERSON
AND IF THERE BE ANY ONE ,IN MY OPINION ,IT CAN BE CHALLENGED AS A BAD RULE OR PRACTICE.

3)MODE OF VOTING MAY BE PRE-LAID IN BY LAWS
OF CHS.
