Urgent- up vat form 38

I have some query regarding UP VAT Form 38.
1. Firstly whether CST registration is required to acquire Form 38 from the department
2. If CST registration is required, whether CST registration from UP is required or CST of other state can be done, as we have CST of other state.
3. Our firm is new, can we download Form 38 or we have to personally take it from department.

Unless you are registered in U.P. under the C.S.T. Act , you can not seek benefits/ concessions allowed under state law . Since after introduction of VAT , the facility for applying for different documents/ forms are available online , you can avail this facility even if registered newly. In case of any difficulty, you can get in touch with the local sales Tax office for guidance.

Thank you Patnaik Ji for reply and thank you to other members also.
So as per your reply, the conclusion which I draw is that I have to get CST registration in UP even though I have CST registration in other State and TIN number in Uttar Pradesh.
Just confirm so that my query is resolved.

There is another query, I have came to know with one of my associate Sales Tax Consultant that for bringing goods to UP no CST is required as the dealer have the TIN No. rather CST is required when goods are to be transfered from UP.
Please help me on this. Whether he is correct.

Sorry for delayed response .
O.K. Mr. Akshaya ,
Form No. 38 under U.P. VAT Act is only a permit to import goods into the state. If you have the limited purpose of importing the goods in question into U.P. and you possess a UP VAT Regn. valid as on date ,you can use the said form. However, you can not make concessional purchase of goods on Form-C condition unless you are registered under C.S.T. Act in UP.
