surety bond

(Querist) 02 October 2009 This query is : Resolved
i had joined the a company at mumbai foregoing my job offer at Mazgon dock as a senior engineer.the company never mentioned of a surety bond but once i joined them then after 1 year asked me to sign a bond of 10 lacs. it is mentioned in the bond that they would provide advance training which they have not done. so i decided to leave now after serving two years the company threatens me of collecting 10 lacs. they have corrected and modified dates without my consent because the intial date mentioned in the bond was before the date of registration ie they call it franking (which is done in redink). will the bond be effective once such breach and tampering has been done without my consent. what are the legal implications if i join another job by resigning the present one

From the details provided by you it appears that bond is in the context of some advance training, which is actually not done. Therefore bond is invalid. In any case bonded labour age is over.
Go ahead with your plans.
All the best.

Can you attach a copy of that bond, so that we can give you proper advice. Or discuss the matter with some local Lawyer and show him the copy of that bond.

No surety bond is executable unless u give consent thereon. In the light of the facts, you have not accepted it hence the threat of the company has no bearing in the eyes of law and you are free to leave as per your wishes.

if u ve not yet signed it then how come u r liable?

and if u signed it then certainly company can not make any changes without ur consent....if u r in possession of the copy of the bond then either show us the scanned copy of visit some local lawyer to get the proper advice.
