Summons thru., whatsapp

I have filed divorce petition of my client. Respodant is living at Dubai. His address is not known only my client his whats app number and mail ID. I have filed an application send the summons thru., whatsapp and email, but judge is not agreeing for that. Is there any recent judgment that summons can be sent thru., whats app and email. And also procedure to send the summons to out side india . Please let me know the judgement and procedure.

Yes, service through WhatsApp & email are valid, you may search and submit Supreme Court judgment(s) besides Bombay High Court judgment in the case titled as State of Maharashtra v. Satish, 2026 SCC OnLine Bom 1419, decided on 12-2-2026

Firstly you should have taken permission from court to send summons through WhatsApp or any other social media, even now you can file a permission petition and proceed if permitted.

It is a general practice followed by all Delhi Courts (Supreme Court, High Court and all 13 District Courts) to direct the plaintiff / petitioner for service of notice(s) / summons through all modes, which include electronic media. I am not aware what about the Court(s) at your end.

Although summons ( Notices )served through WhatsApp and Emails are considered as valid service of summons but it should be the last resort and be used when all the other available means are exhausted so first get served notice through personal delivery/Regd post then opt electronic mode.

First option is to try to serve the summons/notice on the last known address. If not successful, other modes could be attempted with the permission of the Court.
