Stay in gurgaon, 498a in delhi

hi experts,

me and wife stay in guragon after marriage, she has lodged a complaint in delhi caw cell. is it maintainable.

Do you mean to say that both you and your wife as well as both the families are staying in Gurgaon?

If she doesnot has any address in Delhi, the complaint is not maintainable there.

no her father is staying in delhi now. however, he is a govt employee, all other family members are in panipat. my wife is also working in gurgaon. her uncle is a lawyer in delhi.

Hmmm,

I guess then she would have choosen Delhi as jurisdiction, which is good for you, because in Gurgaon or Panipat, you would not have got AB for yourself.

she can file.

otherwise she cant..

Cruelty and Misappropriation are categorized as continuing offences - and on that ground they seem to have premised the jurisdiction there.
