Status of Reserved Category

(Querist) 26 October 2009 This query is : Resolved
Dear Experts,

If a Girl belonging to Reserved Category, got a job in Govt. Sector under Reserved Quota. Now She got married to a man belong to Upper caste. Now the question is what is the Girl's status regarding the Caste. Whether she will lose the job which was secured under reserved cagetory. Thanks.
Adv Archana Deshmukh (Expert) 26 October 2009
In my opinion she will not lose the job. Marrying a person of upper caste won't take away the benefits conferred upon her by the caste to which she belongs.

I also think the same way, she will not lose the job. At the time of recruitment she belonging to Reserved Category.

Mr. Arul, it has been widely interpreted by Hon'ble SC and various HC that mere marrying with a person of Upper Caste would not deprive the spouse of his service joined under the head Reserve Category....even she can not be deprived of her promotional benefits as to be granted to an employee of Reserved Category.

well she will not be able to claim the same benefit for her children.

SHE WILL NOT LOOSE JOB

her status of reservation cannot change, hence she can also use even her husband name along with her name fully or partly.

FOR instance Mrs.Geetha Reddy,AP MINISTER is a daughter of Reserved category couple, married Reddy caste, contesting for last 5 elections on SC category

No change in her status of caste in the given circumstances.

Dear Arul Jee,

Kiran Sir is very right in saying. she will enjoyed the status of reserved category, promotional avenues and etc. marrying to an upper caste person does not compell her to change her status. yes the same benefit will not be enjoined by her wards furthermore.
adv. rajeev ( rajoo ) (Expert) 27 October 2009
She will not loose the benefits. In my opinion it will not be benefited to her children and it should not.
