Sell property which is settled on my name

Sir,
My father had a property in chennai suburbs and he has written a settlement deed (as a gift) in my name couple of years back. I am the only son with no siblings. My father is still alive and the patta is on my father's name.

I am planning to sell that property now. Would I be able to sell that with the current documentation ? Please advice

Hi,
Whether the gift deed you have mentioned is registered? If yes.. then get the mutation done for the revenue records and get your name mentioned as a owner of the property. and then you will be able to sell that propety.

If it is a Gift U can but in case of settlement deed, it will depend on the terms of settlement.

You are not the owner till father is alive. So you cannot sell it.

Do not annoy your father. he can change will any time anywhere, before he dies.

You may show the document in your hands to an able counsel specializing in such/family/property/civil matters, and understand your options.

@Yogen Kakade sir, Yes sir, it is a settlement deed with no extra clause written and it is registered as well.

@Sudhir sir, Sorry to say that I'm not annoying my father, rather the location is under-developed and I don't want to keep it idle.

AS per ur reply , it is a registered Gift Deed which you are talking about, u r free to dispose off the same.

Produce the gift deed to get title in your name.
Once you attain rights equal to that of owner, you can execute the rights of an owner.

Is it a Gift Deed or Settlement Deed, you have confused your query.
However, in both the cases you are valid titleholder and can dispose it off, if the same is registered.
