Section 245(2) of cr. p. c. and documents

(Querist) 08 April 2013 This query is : Resolved 
I am going to file application under Section 245(2) of Cr. P. C. in Criminal Cases related to Dowry/Matrimonial allegation. Can I refer the documents, which are not the part of Charge Sheet, but strong evidence to prove the allegations as false, fraudulent and made to extort money. Please advice me Judgment Citing.

The accused person can also fight for his acquittal.
If you want counter proceeding against the false evidence on oath then filing petition u/s 340 crpc is the option.

You cannot adduce any external material while moving the application under section 245 (2) of criminal procedure code if you have strongest material on file to prove it. Generally such eventuality rarely comes.
