My sister is been married in West Bengal & we hail from Bihar. After 8 years of bad marriage my sister has filed 498(A) against her husband in the year 2012 in Bihar. While this case is still in the court her husband has filled Divorce case of section 13 under matrimonial act in West Bengal. Now as its not safe to travel her to West Bengal, Is it possible to transfer the case to Bihar ?

your sister will have to move supreme court to transfer case to bihar . supreme court will grant her application for transfer of the case

Yes, you can file Transfer petition in suoreme court. It is likely to be allowed.

Yes, the Divorce case can be transferred to Bihar. Move SC.
