Rejoinder affidavit

Dear Sir,

Kindly let me know, is there any limit to file rejoinder affidavit in UP High Court ? In my case opposition file its reply of petition on 4-10-12, but due to distance of around 600km + lawyer denied to proceed , so to arrange another lawyer, it took time around 2 months. Will I be safe or need to put some explanation in court. My case is with State Technical University.

You can file the same when the matter is heard in the next occasion . There is no such time limit.

file rejoinder affidavit in HC before next
date of hearing and send copy to OP by post.

Court will fix the time to file rejoinder. After the specified time if you fail to file your rejoinder, with the permission of the court you can file.

Dear Client,.

If you explasin the delay with some good reasons/causes like being indisposed or non availability of lawyer etc normally thew court grants time for filing rejoinder to your opposition lawyer's COUNTER. In CASE YOU FAIL TO SUBMIT SOMETHING IN YOUR ORIGINAL REJOINDER, WITH THE COURT'S PERMISSION YOU CAN FILE AN AMENDED REJOINDER UNDER order 6 RULE 17 OF C.P.C.
