Registering for less land area

(Querist) 28 July 2009 This query is : Resolved 
I have a property of 1000 sft. however, after road widening only 700 sft is left with me. Now a buyer wants to buy the property but he is asking me to register only for 700 sft. Is there any legal document I have to attach to register for 700 sft ? And what shall I mention in sale deed ?

Yes in the recital of the deed you can mention the fact described by you, it is alright. Further, there is no document to be attached to register the 700 Sft.

no separate document is necessary to be attached.

but the fact of reduction of area due to widening of road will be mentioned in the registration document.

You have to mention that you have purchased 1000 Square Yards under Regd Sale Deed and an area of 300 square yards is affected in Road Widening and net available Area /remaining area is only 700 Square yards with these recital in the sale Deed you can sell the 700 Square yards land asserting your title under Your Regd sale deed . You can give, to the purchaser, your Original Regd Sale deed and proceeding ( if any ) under which the 300 sq Y is acquired/taken for Road
