Can I get the custody of my daughter who is 13 years old and is with my wife, we are seperated since 2000 and i am fighting for divorce since 2005.

you can make application for custody of your daughter but court may award you visitation rights . welfare of child id paramount consideration

What were you doing for last 12 years?

Chances are bleak unless the abuse is there.

You want welfare of your daughter. I am surprised that who is binding you?

You send a nice gift of Rs 10,000/- to her today and i think no body will obstruct you.

But I think a Mother is more friendly to a daughter of 12 year And the Courts also thinks so.

No, in normal course you will not get her custody. You may get her custody only on the ground of her welfare if you can prove to the Court that your wife is incapable of bringing her up.
