Query related to stridhan

(Querist) 23 July 2013 This query is : Resolved
Sir,

I have a query related to my stridhan. My in laws had refused/denied to return my stridhan.

My godbharai/thaka function was held in Delhi and marriage was solemnized in Uttrakhand. In both the functions, we have gave gold jwellery and other articles to my in laws in Delhi and Uttrakhand.

My question is :-

1) Whether I file suit u/s 406 IPC in Delhi or not?
2) Where is the jurisdiction for filing the case?

Kiran Kumar (Expert) 23 July 2013
S. 181 of Cr.P.C is relevant for your case.

Keeping in view that provision and keeping in view the facts and circumstances of the case you may file the case at either of the places as the part of the property was given at Delhi and part was given at Uttarakhand.

Seek assistance of your local lawyer at Delhi and ask him to act as per the provisions of S. 181(4) of Cr.P.C
