Prosecution Witness statement and Cross examination

Dear All
In My case, the trial has just commenced after framing of charges. Now court has summoned two prosecution witness for recording their statement.

My querry is , that cross examination is done on the same day, after recording of statement or it is being done on next date or at other time, please clarify.

Generally cross-examination of a witness is recorded on the same day when his examination-in-chief is recorded. However, if the court finds it in the interest of justice for any justifiable reason, the cross-examination may be deferred and may be recorded on any subsequent date.

Cross Examination be done on the same day of evidence of prosecution witness and if your lawyer take adjournment on his personal or some other ground in that event its court's discretion to allow time to you or not.

It depends upon the dence counsel. If he insists for adjournment then the same will be made on the next occassion or else on the same day.

You can defer the cross examination.

Generally Court orders the Accused to pay the travelling charges for witnesses as 'Beta'. Then it deffer the Cross-Examination, but Prosecution can raise an objection (in the contest or serious matters) on several grounds (depend upon your case), but the reason should be strong for adjournment, in my trail court my Officer used to record the reason what you stated before him as it is !
